Subject: Transfer of Deed to City from Brushy Creek Regional Wastewater Treatment Plant
During the construction of a roadway from Highway 79 extending southward across the Union Pacific Railroad along the
western edge of the Brushy Creek Regional Wastewater Treatment Plant, the City of Round Rock Transportation
Department inadvertently encroached onto the treatment plant property. The roadway Right -of -Way (ROW) extended
onto 0.981 acres (42,720 square feet) of the property, which is owned by the three partner Cities of Austin, Cedar Park, and
Round Rock. This alignment mishap was detected after the construction of the roadway had commenced; therefore, the
three Cities agreed to transfer this portion of the treatment plant property over to the City's Transportation Department.
Per this verbal agreement, the City of Round Rock would reimburse the Cities based on Williamson County's tax appraised
value of the land. Each City will receive payment based on their percentage ownership of the total value of the 0.981 acres
valued at a total of $63,765 (or $65,000/acre) according to the latest WCAD valuation as follows:
• Austin - $2,187.14
• Cedar Park - $9,316.07
• Round Rock (Utilities) - $52,261.79
Attached is a copy of the recorded deed in the Williamson County courthouse.
This agreement is acknowledged by the Round Rock City Manager below.

During the construction of a roadway from Highway 79 extending southward across the Union
Pacific Railroad along the western edge of the Brushy Creek Regional Wastewater Treatment
Plant, the City of Round Rock Transportation Department inadvertently encroached onto the
treatment plant property. The roadway Right -of -Way (ROW) extended onto 0.981 acres
(42,720 square feet) of the property, which is jointly owned by the Cities of Austin, Cedar Park,
and Round Rock. This alignment mishap was detected after the construction of the roadway
had commenced; therefore, the three Cities agreed to transfer this portion of the treatment plant
property over to the City of Round Rock's Transportation Department. Per this verbal
agreement, the City of Round Rock would reimburse each City based on Williamson County's
tax appraised value of the land. Each City will receive payment based on their percentage
ownership of the total value of the 0.981 acres valued at a total of $63,765 (or $65,000/acre)
according to the latest WCAD valuation as follows:
• Austin - $2,187.14
• Cedar Park - $9,316.07
• Round Rock (Utilities) - $52,261.79
As the roadway project that encroached onto the treatment plant property is associated with the
off -site roadway improvements for the proposed Kalahari Resort Development, the cost for the
purchase of the ROW will come from the allotment of $15M for off -site roadway improvements.
