That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the Counties
of Travis and Williamson, State of Texas ("Releasor"), with mailing address of 221 East Main Street, Round
Rock, Texas 78664, for and in consideration ofthe sum of Ten and No/100 Dollars ($10.00) and other good
and valuable consideration paid by ORLANDO PEREZ, whose address is 3614 Camousty Cove, Round
Rock, Texas 78664, Williamson County, Texas, the receipt and sufficiency of which is hereby
acknowledged, does hereby ABANDON, RELEASE and DISCHARGE the portion of a Public Utility
Easement ("PUE") encumbering the below -described property, to -wit:
5-foot wide portion of a 10-foot wide PUE:
The innermost five (5) feet of a ten (10) foot wide public utility easement located
along the rear property line of Forest Creek Section 28, Block A, Lot 29,
affecting 3614 Camousty Cove; said area more particularly shown in Exhibit
"A", attached hereto and incorporated herein by reference.
This instrument is given specifically to release a portion of the described said easement to the extent
Releasor is Grantee of said easement, which easement is partially terminated by abandonment, termination,
vacation, and cessation of purpose, and which portion of said easement will be of no further effect, whether
legal or equitable.
IN WITNES OF, the City of ound Rock, Texas has caused this instrument to be

This is an application to vacate the innermost 5-feet of a 10-foot wide PUE located along the
rear property line. Section 10-33 of the Subdivision Ordinance allows a landowner to request a
nullification of an easement established by an approved plat or by separate instrument. The
purpose of the requested vacation is to allow the homeowner additional space for the
construction of a pool and the associated deck.
For informational purposes, this is the same lot that a code amendment was initiated for to
eliminate the 5-foot rear setback requirement for homes that do not abut other single-family lots.
The City of Round Rock Utilities and Environmental Services Department has consented to the
proposed vacation.
Staff recommends approval of the easement vacation.
