PROJECT: Railroad Ouiet Zone Study
This Supplemental Contract No. 7 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and BGE, Inc., hereinafter called
the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 22nd day of March, 2012 for the Railroad Quiet Zone Study Project
in the amount of $149,900.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on August 17, 2012
to amend the scope of services and to increase the compensation by $25,123.80 to a total of
$175,023.80; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on June 13, 2013 to
amend the scope of services and to increase the compensation by $141,700.51 to a total of
$316,724.31; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on June 26, 2014 to
amend the scope of services and to increase the compensation by $19,950.00 to a total of
$336,674.31; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 4 on February 26, 2016
to amend the scope of services and to increase the compensation by $47,425.00 to a total of
$384,099.31; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 5 on July 13, 2018 to
amend the scope of services and to increase the compensation by $29,472.00 to a total of
$413,571.31; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 6 on July 19, 2019 to
amend the scope of services and to increase the compensation by $27,425.00 to a total of
$440,996.31; and

WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $29,644.00 to a total of $470,640.31;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set
forth in the attached Addendum to Exhibit C.
II.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$29,644.00 the lump sum amount payable under the Contract for a total of $470,640.31, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Contract in duplicate.

ADDENDUM TO EXHIBIT B
Engineering Services
Preface
The scope of services for this Supplemental Contract No. 7 shall be to continue to
provide professional services for the implementation phase of the railroad quiet zone
project in the City of Round Rock (City). These services shall include continuation of:
project management and coordination efforts; approval of contractor invoices,
coordination for railroad preemption, final inspection of construction, preparation
of Notice of Establishment for the Quiet Zone (NOE), and assisting the City with
any further coordination efforts with the Union Pacific Railroad (UPRR), the
Texas Department of Transportation (TxDOT) and the Federal Railroad
Administration (FRA).
The duration of the project is being extended by approximately 4 months, as a result of
additional coordination activities required by UPRR in order to finalize project
implementation. The Engineer will perform the following tasks:
A. Project Management and Scheduling
1. Prepare monthly or bi-monthly reports as needed to document project progress.
2. General project management and coordination with the City, UPRR, TxDOT;
client communication for completion of project implementation; assist the city
resolving issues and questions from various agencies.
3. Meetings with client, UPRR, and TxDOT as needed to address outstanding issues
with permitting, reviews, and required documentation including on-line meetings.
4. Quality Assurance and Quality Control.
B. Preliminary Engineering Agreements
1. Preparation of Notice of Establishment (NOE) for the Quiet Zone, including Quiet
Zone Risk Index calculations, and preparation of Attachments A through H.
F. Construction Support
1. Field review of the completed construction project and punch list of items
requiring attention from Contractor.
2. Review and approve invoices from the Contractor.

Consider a resolution authorizing the City Manager to execute Supplemental Agreement No. 7
with Brown and Gay Engineering, Inc. for the Quiet Zone Project.
On March 22, 2012 the City of Round City Council approved a contract with Brown & Gay
Engineers, Inc for the Railroad Quiet Zone Study in the amount of $149,900.00
Supplemental No. 1 was approved on August 17, 2012 in the amount of $25,123.80 bringing
the total contract price to $175,023.80. The scope of services for this Supplement allowed for
professional services for the implementation phase of the railroad quiet zone project.
Supplemental No. 2 was approved on June 13, 2013 in the amount of $141,700.51 bringing the
total contract price to $316,724.31. The scope of services for this Supplement allowed for
professional services for the implementation phase of the railroad quiet zone project including
preliminary plan set.
Supplemental No. 3 was approved on June 26, 2014 in the amount of $19,950.00 bringing the
total contract price to $336,674.31. The scope of services for this Supplement allowed for
professional services for the implementation phase of the railroad quiet zone project.
Supplemental No. 4 was approved on February 26, 2016 in the amount of $47,425.00 bringing
the total contract price to $384,099.31. The scope of services for this Supplement allowed for
professional services for the implementation phase of the railroad quiet zone project. These
services included project management, updates to project plans due to additional

requirements, updates to environmental documents, scheduling and coordination efforts.
Supplemental No. 5 will continue the ongoing professional services for project management,
updates to the plans and continued coordination with the City and Union Pacific Railroad in the
amount of $29,472.00 bringing the total contract price to $413,571.31.
Supplemental No. 6 will provide engineering professional services to provide to UPRR plan
drawings of the proposed bore for the signal timing and railroad coordination and to update any
permits or plans associated with the Quiet Zone work. This project has been extended
approximately 14 months as a result of delays incurred in the Union Pacific Railroad utility and
ROE (Right -of -Entry) permitting. This supplemental agreement is in the amount of$25,624.60
bringing the adjusted contract amount to $ 439,195.91.
Supplemental No. 7 is for the final engineering efforts to write the NOE ( Notice of Enforcement)
for the quite zone. A 60 day comment period is associated with that NOE. A final walk through
and to coordinate any further tasks with UPRR. This supplemental is in the amount of
$29,644.00 bringing the total contract to $ 470,640.31.
