CM-2020-231 - 9/4/2020STATE OF TEXAS § COUNTY OF WILLIAMSON § SUPPLEMENTAL CONTRACT NO.1 TO CONTRACT FOR ENGINEERING SERVICES FIRM: HENDRIX CONSULTING ENGINEERS ("Engineer") ADDRESS: 115 East Main Street, Round Rock, TX 78665 PROJECT: Downtown Historic Water Tank - Lighting This Supplemental Contract No. 1 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Hendrix Consulting Engineers, hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 5th day of April, 2019 for the Downtown Historic Water Tank - Lighting Project in the amount of $40,000.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $19,004.00 to a total of $59,004.00; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. II. Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $19,004.00 the maximum amount payable under the Contract for a total of $59,004.00, as shown by the attached Addendum to Exhibit D. Ongoing construction administration for water tower. 2. Ongoing site visits. ADDENDUM TO EXHIBIT C Work Schedule Water Tower Lighting Project. 1. Original hourly contract was exhausted on approximately 10/15/19. 2. 105 additional hours were required to finish CA on water tower. This was not measured in site visits. 3. The City was only charged straight time hourly rates. Even though many visits were after hours, no overtime rates were charged to the City. 4. Above and beyond the billed number of hours in Item 2, there were 33 hours donated byHCE, and not charged to the City. This is indicated in the attached "Goodwill' billing. The original downtown water tank, now referred to as the Downtown Historical Tank was erected by Pittsburgh -Des Moines Steel Company (PDM) in 1936 and immediately placed in service. It remained in service until 1986 when the Lake Creek well system and ground storage tank were constructed. The tank is an icon of Round Rock and is visible to the entire downtown area. On April 5, 2019, the City Manager authorized the City to enter a contract with Hendrix Consulting Engineers (HCE), P.C. for $40,000 to design the new lighting system that was constructed and completed last December in time for the Christmas season. During construction of the lighting contract with Environmental Lighting Service (ELS), it was necessary for HCE to visit the site daily rather than "as necessary" as defined in their original contract agreement. HCE is requesting $19,004 to cover the additional Project Managers time in the field during installation of the lights on the tank.
