The project consists of the construction of 5 concrete pads and installation of pre -fabricated accessible bus shelters and also the installation of benches and trash cans. Currently at the locations where these 5 bus shelters will be constructed there are designated bus stops. Four (4) of the locations consist of a pole with bus stop number, concrete slab, bench and trash bin; the fifth stop only has a pole and information for the rider (see attached pictures). I researched ERR's that are available from HEROS just to see what determinations other cities used with similar projects. Some of the projects had the same description and some projects were replacing existing bus shelters with newer more accessible bus shelters. I found that the two same determinations were used for the project ERRs that I found. 58.35 (a) (1) : Acquisition, repair, improvement, reconstruction, or rehabilitation of public facilities and improvements (other than buildings) when the facilities and improvements are in place and will be retained in the same use without change in size or capacity of more than 20 percent (e.g., replacement of water or sewer lines, reconstruction of curbs and sidewalks, repaving of streets); 2. 58.35 (a) (3) (iii): In the case of non-residential structures, including commercial, industrial, and public buildings: (A) The facilities and improvements are in place and will not be changed in size or capacity by more than 20 percent; AND (B) The activity does not involve a change in land use, such as from non-residential to residential, commercial to industrial, or from one industrial use to another. Both determinations were used by different cities for project descriptions similar to mine and also both were used by cities with description replacing existing shelters. I don't think the second one is correct because I think it's meant for buildings. I think the first one is what I should use because I am replacing existing bus shelters and retaining for the same use BUT then there is the issue of the 20% change in size or capacity. Does replacing existing with new ADA concrete slab, pre-fab shelter, bench and trash bin constitute 20% change? It's definitely an upgrade but it won't take up much more space I feel. What I can say if that the nature and location of this project site(s) will not require any mitigation for compliance with any listed statutes or authorities nor will it require any formal permit or license. The release may be contained with a single property's boundaries or may extend across property boundaries onto other properties. The boundaries can, and often do change as further information on the extent and degree of contamination is obtained. This database returned no results for your area CERCLIS List CERCLIS List The United States Environmental Protection Agency (EPA) investigates known or suspected uncontrolled or abandoned hazardous substance facilities under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). EPA maintains a comprehensive list of these facilities in a database known as the Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS). These sites have either been investigated or are currently under investigation by the EPA for release or threatened release of hazardous substances. Once a site is placed in CERCLIS, it may be subjected to several levels of review and evaluation and ultimately placed on the National Priority List (NPL). CERCLIS sites designated as "No Further Remedial Action Planned" (NFRAP) have been removed from CERCLIS. The ERR shall be available for public review and must contain all of the recommended formats. The ERR must include all of the environmental review documents, public notices, written determination and any environmental review findings pertaining to the decision making and actions related to the individual project. The CDBG South Mays Street Corridor Bus Stops Project required that a Categorical Exclusion Subject to 58.5 Determination 24 CFR 58.34 (a) (12) ERR be conducted and executed by the Certifying Officer. The CDBG South Mays Street Corridor Bus Stops Project consists of replacement of five (5) bus stops along the South Mays Street Corridor at the following locations: 1. Mays Street & Shipley's Donuts 2. Mays Street and Mays Crossing (on the East Side) 3. Mays Street and Mays Crossing (on the West Side) 4. Mays Street and Tower 5. Mays Street and Short Trail The project consists of replacement of existing bus stops with ADA accessible concrete slabs, bus shelters, benches and trash bins. Project cost is estimated at $130,000.
