The US Justice Department's asset forfeiture guidelines allow agencies to transfer and convert tangible property seizures for agency use once the forfeiture process is complete. As part of that process, the seizing agency agrees to pay the federal government's share, costs and expenses and track the property in its inventory. The cost in this case is 20 percent of the vehicle's estimated $8,575 value ($1,715), plus storage and any related fees associated with the vehicle. Stuart Assistant Chief of Police TO: Drug Enforcement Administration, Asset Removal Group FROM: Round Rock Police Department, City of Round Rock City Manager DATE: November 12, 2020 RE: 2015 Jeep Cherokee (20-DEA-666053) On July 13, 2020, members of the Round Rock Police Department (RRPD) responding to a Subject with a Gun complaint conducted a high -risk traffic stop which produced a usable amount of marijuana, in addition to currency, a firearm, and ammunition. The Department seized currency and a 2015 Jeep Cherokee (Seizure No: N-2, Processing Agency Case No: M8-20-0030) as drug proceeds and for facilitation. As required by Section V.(C)(1) of the U.S. Department of Justice's Guide to Equitable Sharing for State, Local and Tribal Law Enforcement Agencies, "Transfer of Forfeited Tangible Property," this letter is being submitted as a request for approval to utilize the 2015 Jeep Cherokee for official law enforcement use in lieu of proceeds. If approved, I understand RRPD will be responsible for reimbursing the federal government for cost and expenses, the federal share, and tracking the property in our inventory. I understand that if this asset is transferred to the RRPD, we must use it for at least two years unless it becomes unsuitable for law enforcement use, whereupon it may be sold with approval from the DOJ' s Money Laundering and Asset Removal Section (MLARS). RRPD plans to utilize the 2015 Jeep Cherokee for undercover and surveillance operations and for tactical operations.
