DECLARATION OF WASTEWATER EASEMENT
THE STATE OF TEXAS
KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON
WHEREAS, the City of Round Rock is the owner of 209.227 acres of land described as
Kalahari Resort and Replat of Bertil Telander Subdivision, as recorded in Document No.
2018035349 of the Official Plat Records of Williamson County, Texas (the "City Property"); and
WHEREAS, the City of Round Rock desires to use a portion of the City Property for
location of a wastewater easement ("Wastewater Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of a Wastewater Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant') has executed this Declaration of a Wastewater Easement for
the purpose of establishing the following exclusive easement in and under the following
described property in Williamson County, Texas, to -wit:
Being a 0.243 acre of land (approximately 10,557 square feet), being out of and a
portion of the P.A. Holder Abstract No. 297, Williamson County, Texas, also
being a portion of Lot 1, Block A of Kalahari Resort and Replat of Bertil Telander
Subdivision, recorded in Document No. 2018035349 of the Official Public
Records of Williamson County, Texas (O.P.R.W.C.T.), Lot 1, Block C of said
Kalahari Resort and replat of Bertil Telander Subdivision, the remainder of a
called 61.496 acre tract of land conveyed to the City of Round Rock, Texas in
Document No. 2017001676, O.P.R.W.C.T., and the remainder of a called 178.28
acre tract of land conveyed to the City of Round Rock, Texas in Document No.
2017001675, O.P.R.W.C.T., hereinafter designated by Part 1, Part 2 and Part 3;
said 0.243 acre tract being further described by metes and bounds and sketch in
Exhibit "A," incorporated herein for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
to construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and

remove a wastewater system and lines, together with all necessary lines, pipes, conduits, valves,
vaults, manholes, ventilators, and other equipment, improvements, accessories and
appurtenances or operations and any other necessary accessories thereto.
Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. However, it is expressly provided that this Declaration may be modified,
amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.
