That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the
Counties of Travis and Williamson, State of Texas ("Releasor"), with mailing address of 221 East
Main Street, Round Rock, Texas 78664, for and in consideration of the sum of Ten and No/100
Dollars ($10.00) and other good and valuable consideration paid by STEVE HICKERSON
FAMILY PARTNERSHIP, LTD., a Texas limited partnership, with mailing address of P.O. Box
789, Round Rock, Texas 78680, the receipt and sufficiency of which is hereby acknowledged,
does hereby ABANDON, RELEASE and DISCHARGE the 10' Public Utility Easement located
at 1200 IH 35, Round Rock, Texas ("Easement"), recorded in Cabinet B, Slide 301, Plat Records
of Williamson County, Texas, encumbering the below -described property, to -wit:
A description of 2,742 square feet of land out of Lot 1, Block B, Chisholm Valley Section
1, a subdivision recorded in Cabinet B, Slide 301, Plat Records of Williamson County,
Texas; said 2,742 square feet of land being more fully described by metes and bounds
and shown by sketch in the attached Exhibit "A," incorporated herein by reference for all
purposes.
This instrument releases the Easement in its entirety, with the exception of the existing
aerial only portion of the Easement for lines consisting of variable number of wires, and all
necessary or desirable aerial appurtenances. Releasor shall have the right on ingress and egress
over the surface area of the Easement for the sole purpose of constructing, reconstructing,
inspecting, patrolling, pulling new wire on, maintaining and removing said aerial lines and
appurtenances; the right to relocate within the limits of the Easement; the right to remove from
said lands all trees and parts thereof, or any other obstructions which endanger or may interfere
with the efficiency of said lines or their appurtenances.
This instrument is given specifically to release the described said portion of the Easement
to the extent Releasor is Grantee of said Easement, which portion of said Easement is terminated
by abandonment, termination, vacation, and cessation of purpose, and which portion of said
Easement will be of no further effect, whether legal or equitable.

The owner of the property constructed a building in the P.U.E. Franchised utilities have agreed to abandon
their rights on the ground, but wish to retain aerial rights. This partial release vacates the ground portion
of their rights to the easement, and preserves the aerial rights for franchise utilities.
The Utilities department will dedicate a separate drainage and stormwater easement in a separate
document for a proposed drainage line installation. The Utilities director does not need access to the
subject P.U.E., and approves the request to release the ground rights in the P.U.E.
