THIS SUPPLEMENTAL AGREEMENT NO. 1 to "City of Round Rock Agreement for
Professional Consulting Services for Environmental Services with POWER Engineers, Inc."
hereinafter called "Supplemental Agreement No. 1," is made by and between the CITY OF
ROUND ROCK, a Texas home -rule municipality (hereinafter referred to as the "City"), located
at 221 East Main Street, Round Rock, Texas 78664, and POWER ENGINEERS, INC., whose
offices are located at 2600 Via Fortuna, Suite 450, Austin, Texas 78746 (hereinafter referred to
as "Consultant").
WHEREAS, the City and Consultant previously executed the referenced "City of Round
Rock Agreement for Professional Consulting Services for Environmental Services" (hereinafter
referred to as the "Agreement") on January 10, 2019 by Resolution No. 2019-0023; and
WHEREAS, it has become necessary to amend the Agreement to extend the term of the
Agreement for an additional twelve (12) months; and
NOW THEREFORE, premises considered, and in consideration of the mutual promises
and obligations in the Agreement and this Supplemental Agreement, the City and Consultant
agree as follows:
I.
That Section 1.0, Effective Date, Duration, and Term, is hereby amended to extend the
term of the Agreement through December 31, 2021.
II.
That Section 5.0, Contract Amount, is hereby amended to include Addendum to Exhibit
"D" entitled 2021 "Fee Schedule," attached hereto and incorporated herein by reference for all
purposes.

This First Supplemental Agreement shall amend the original Agreement only as set forth
herein with no other changes in terms of conditions of the original Agreement.
IN WITNESS WHEREOF, the City and Consultant have executed this Supplemental
Agreement No. 1 to be effective as of the last date of due execution by both parties.

DIRECT CHARGES
Direct expenses and subcontractor costs shall be billed at actual costs plus 5%. Rates for in-
house copies are ten (10) cents per black and white copy and fifty (50) cents per color copy.
Other direct charges, including mileage, will be charged at cost plus 5 % . Mileage cost is
based on the current acceptable Internal Revenue Service reimbursement limit.

The City currently has a contract with Power Engineers, Inc. for environmental consulting services to assist
with various tasks including but not limited to the following:
- Environmental Review, Permitting and Analysis
- Hazardous Materials, Hazardous Waste, and Solid Waste Management
Facilities Environmental Management & Inspections
Storm Water Management
Several departments in the City have utilized this contract for various environmental services. The current
$250,000 lump sum contract with Power Engineers, Inc. expired on December 31, 2020. Therefore, this
Supplemental Contract No. 1 will extend the term of the contract for another year with an expiration date
of December 31, 2021. Funding sources will continue to be determined by individual work authorization
agreements under this contract not to exceed the previously approved $250,000 contract amount.
