KNOW ALL BY THESE PRESENTS:
WHEREAS, the City of Round Rock is the owner of 9.796 acres recorded in Document
No, 2016119806 and 0.864 acres recorded in Document No. 2011041098 of the Official Public
Records of Williamson County, Texas (the "City Property"); and
WHEREAS, the City of Round Rock desires to use a portion of the City Property for
location of a water line easement ("Water Line Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of a Water Line Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of a Water Line Easement for
the purpose of establishing the following exclusive easement in and under the following
described property in Williamson County, Texas, to -wit:
Being a 0.570 acre of land (approximately 24,846 square feet), being out of and a
portion of the P.A. Holder Abstract No. 297, Williamson County, Texas, also
being a portion of Tract 4, a called 9.796 acre tract of land conveyed to the City of
Round Rock, Texas in document No. 2016119806 of the Official Public Records
of Williamson County, Texas (O.P.R.W.C.T.), also being a portion of Parcel 4, a
called 0.864 acre tract of land conveyed to the City of Round Rock, Texas in
Document No. 2011041098, O.P.R.W.C.T.; said 0.570 acre tract being further
described by metes and bounds and sketch in Exhibit "A," incorporated herein for
all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
to construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove a water distribution system and water lines, together with all necessary lines, pipes,
conduits, valves, vaults, manholes, ventilators, and other equipment, improvements, accessories
and appurtenances or operations and any other necessary accessories thereto.

Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. However, it is expressly provided that this Declaration may be modified,
amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.
