DECLARATION OF WASTEWATER EASEMENT

§ KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
WHEREAS, the City of Round Rock is the owner of 9.796 acres recorded in Document
No. 20161 19906 and 12.1 acres recorded in Document No. 2013049009 of the Official Public
Records of Williamson County, Texas (the "City Property"); and
WHEREAS, the City of Round Rock desires to use a portion of the City Property for
location of wastewater easement ("Wastewater Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of a Wastewater Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of a Wastewater Easement for
the purpose of establishing the following exclusive easement in and under the following
described property in Williamson County, Texas, to -wit -
Being a 0.258 acre of land (approximately 11,232 square feet), being out of and a
portion of the P.A. Holder Abstract No. 297, Williamson County, Texas, also
being a portion of Tract 4, a called 9.796 acre tract of land conveyed to the City of
Round Rock, Texas in document No. 2016119806 of the Official Public Records
of Williamson County, Texas (O.P.R.W.C.T.), also being a portion of a called
12.1 acre tract of land conveyed to the City of Round Rock, Texas in Document
No. 2013049009, O.P.R.W.C.T.; said 0.258 acre tract being further described by
metes and bounds and sketch in Exhibit "A," incorporated herein for all purposes.
The perpetual easement, right-of-way, rights and privileges herein granted shall be used
to construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove a wastewater system and lines, together with all necessary lines, pipes, conduits, valves,
vaults, manholes, ventilators, and other equipment, improvements, accessories and
appurtenances or operations and any other necessary accessories thereto.

Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be responsible or liable for any damage to utilities placed within the easement caused by
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. However, it is expressly provided that this Declaration may be modified,
amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.

COMMENCING at a 1/2-inch iron rod found at an angle point in the west right-of-way line of S.
Kenney Fort Blvd.(R,O.W. width varies) described in Document No. 2011041097, O.P.R.W.C.T. at
the most easterly common corner of the said 9.796 acre tract and the said 12.1 acre tract;
THENCE South 03°25'21" East, with the west right-of-way line of S. Kenney Fort Blvd., being the
east line of the said 12.1 acre tract, a distance of 13.64 feet to a calculated point in a northerly line of
a Wastewater Easement recorded in Volume 1365, Page 1 of the Deed Records of Williamson
County, Texas;
THENCE leaving the west right-of-way line of S. Kenney Fort Blvd., being the east line of the said
12.1 acre tract, with the north line of the said Wastewater Easement, the following two (2) courses
and distances:
1. South 77°39'59" West, with the north line of the said Wastewater Easement, a distance of
110.96 feet to a calculated point;
2. North 83°39'15" West, a distance of 2.62 feet to a calculated point for the POINT OF
BEGINNING and southeast corner of the herein described tract of land, having Texas State
