R-2021-087 WHEREAS, Zoning and Development Code, Chapter 8, Article III, Sec. 8.18, Code of Ordinances (2018 Edition), designates certain trees in the City as Monarch Trees, and WHEREAS, Monarch Trees are protected and may not be removed unless the monarch designation is removed by the City Council, and WHEREAS, Blair Landscape Architecture, LLC has submitted a request on behalf of the owner InTown Homes to remove the monarch designation for a tree numbered 4144 located adjacent to the proposed development site of the Depot Townhomes, as described on Exhibit "A", Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the monarch designation for a tree numbered 4144 located adjacent to the proposed development site of the Depot Townhomes, as described on Exhibit "A", is hereby removed. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 5 51, Texas Government Code, as amended. While Tree #4144 is still healthy, the overall looks and architecture of the tree place it on the lower end of the spectrum in terms of desirable Monarch preservation. Additionally, the economic, social and aesthetic value that The Depot Townhomes will bring to downtown Round Rock should be discussed when considering the removal of this tree.
