DECLARATION OF AN ACCESS EASEMENT

KNOW ALL BY THESE PRESENTS:
WHEREAS, the City of Round Rock is the owner of 9.796 acres of property conveyed
to the City in Document No. 20161 19806 of the Official Public Records of Williamson County,
Texas (the "City Property"); and
WHEREAS, the City of Round Rock desires to use a portion of the City Property for
location of an access casement ("Access Easement");
NOW, THEREFORE, in consideration of the foregoing premises, the City of Round
Rock makes the following Declaration of an Access Easement:
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of an Access Easement for the
purpose of establishing the following exclusive easement in and under the following described
property in Williamson County, Texas, to -wit ("Easement Area"):
Being a 0.037 acre of land (approximately 1,616 square feet), being out of and a
portion of the P.A. Holder Abstract No. 297, Williamson County, Texas, also
being a portion of Tract 4, a called 9.796 acre tract of land conveyed to the City of
Round Rock, Texas in Document No. 2016119806 of the Official Public Records
of Williamson County Texas (O.P.R.W.C.T.); said 0.037 acre of land being
further described by metes and bounds and sketch in Exhibit "A," incorporated
herein for all purposes.
The Access Easement rights and privileges herein granted herein shall be for the
uninterrupted ingress and egress for persons, vehicles, and equipment necessary or convenient
for use in the Easement Area.
Declarant retains, reserves, and shall continue to enjoy the surface of such Access
Easement for any and all purposes which do not interfere with and prevent the use of the Access
Easement.

ACRE TRACT OF LAND CONVEYED TO THE CITY OF ROUND ROCK, TEXAS IN
DOCUMENT NO. 2016119806 OF THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON
COUNTY, TEXAS (O.P.R.W.C.T.); SAID 0.037 ACRE OF LAND BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
COMMENCING at a 1/2-inch iron rod with Baker-Aicklen cap found at an angle point in the west
right-of-way line of S. Kenney Fort Blvd. (R.O.W. varies) described in Document No.
2011041097, O.P.R.W.C.T., being the east line of the said 9.796 acre tract;
THENCE South 00*08'28" East, with the west right-of-way line of S. Kenney Fort Blvd., being
the east line of the said 9.796 acre tract, a distance of 27.71 feet to a calculated point for the
POINT OF BEGINNING and the northeast corner of the herein described tract of land, having

299.66 feet, and from this angle point in same line, a 1/2-inch iron rod found at another angle

said 9.796 acre City of Round Rock, Texas tract and a called 12.1 tract of land conveyed to the

West, a distance of 165.92 feet;
THENCE leaving the west right-of-way line of S. Kenney Fort Blvd., being the east line of the
said 9.796 acre tract, crossing the said 9.796 acre tract, the following five (5) courses and
distances:
South 89"51'44" West, a distance of 42.41 feet to a calculated point for the southwest
comer of the herein described tract of land;

This is a declaration of an access easement to the City to allow vehicular cross -connectivity between
adjacent properties. The easement is located on City property and the neighboring property to which it
connects is also City property. The City is both the Grantor and Grantee and the easement and associated
paved infrastructure located in it is controlled by the City.
