CM-2021-195 - 7/9/2021STATE OF TEXAS § COUNTY OF WILLIAMSON § SUPPLEMENTAL CONTRACT NO.3 TO CONTRACT FOR ENGINEERING SERVICES FIRM: CP&Y, INC. ("Engineer") ADDRESS: 13809 Research Blvd., Suite 300, Austin, TX 78750 PROJECT: Northeast Downtown Improvements This Supplemental Contract No. 3 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and CP&Y, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 12th day of September, 2019 for the Northeast Downtown Improvements Project in the amount of $960,600.54; and WHEREAS, the City and Engineer executed Supplemental Contract No. I on April 24, 2020 to amend the scope of services and to increase the compensation by $22,482.00 to a total of $983,082.54; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on November 12, 2020 to amend the scope of services and to increase the compensation by $137,950.00 to a total of $1,121,032.54; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $18,500.00 to a total of $1,139,532.54; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $18,500.00 the maximum amount payable under the Contract for a total of $1,139,532.54, as shown by the attached Addendum to Exhibit D. Additional project management is included for the aforementioned work The tasks and products are more fully described in the following TASK OUTLINE. TASK OUTLINE III. ADDITIONAL SERVICES F. Additional effort for Supplemental No. 3: I. CONSTRUCTION ASSISTANCE (a) Assist with an additional five (5) RFIs for dry utility specific requests. (b) Perform a site visit to address RFI concerns regarding the installation of dry utility specific facilities along Austin Avenue. (c) Update dry utility sheets andlor create new exhibits based on RFl requests. (d) Generate record drawing of dry utility P&P sheets with information provided by the City or its contractor to inventory the actual locations of installations or as-builts. No additional field investigations or survey will be completed as a part of this work by the consultant. The proposed utility and roadway improvements associated with this project will revitalize this area, support the new library site, and support future development in this part of Downtown. This Supplemental No. 3 is for additional Request for Information (Rfls) review, site visits, exhibit development, record drawing development associated with the dry utility elements of the project, and project management. This supplemental increases the compensation to CP&Y by $18,500, and brings the total contract amount to $1,139,532.54.
