A RESOLUTION OF THE CITY OF ROUND ROCK, TEXAS,
CONSENTING TO THE ANNEXATION OF LAND INTO ROUND
ROCK MUNICIPAL UTILITY DISTRICT NO. 2 AND CONTAINING
RELATED FINDINGS AND PROVISIONS
WHEREAS, Cressman Enterprises LP, a Texas limited partnership, Meritage
Homes of Texas, LLC, an Arizona limited liability company, and Tri Pointe Homes Texas,
Inc., a Texas corporation, formerly known as Trendmaker Homes, Inc., a Texas corporation
(collectively, the "Petitioners"), owners of the land more fully described on Exhibit"A"
attached hereto and incorporated herein by reference for all purposes (the "Pro er ";
Cressman Enterprises LP owning the portions of the Property described on Exhibits "A-ill
and "A-2", respectively, and Meritage Homes of Texas, LLC and Tri Pointe Homes Texas,
Inc. jointly owning the portion of the Property described on Exhibit intend to
petition Round Rock Municipal Utility District No. 2 (the "District") for the annexation and
inclusion of the Property into the boundaries of the District; and
WHEREAS, the Property is located within the corporate limits of the City of Round
Rock, Texas (the "CUW") and the City's consent to annexation of the Property by the District
is required by applicable law, including, without limitation, Section 54.o16 of the Texas
Water Code; and
WHEREAS, Petitioners have requested that the City consent to the proposed
annexation and inclusion of the Property into the District by ordinance or resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ROUND ROCK, TEXAS:
Section 1. Consent. The City hereby grants the Petition and, by this Resolution,
gives its written consent to the annexation of the Property into the boundaries of the
District.
Section 2. Effective Date. This Resolution shall be effective from and after its
passage on the date shown below.
Section 3. Open Meeting. It is hereby officially found and determined that the
meeting at which this Resolution was considered was open to the public, and public notice
of the time, place, and purpose of said meeting was given, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.
