CITY OF ROUND ROCK ) STATE OF TEXAS ) COUNTY OF WILLIAMSON ) COUNTY OF TRAVIS ) KNOW ALL BY THESE PRESENTS: This Supplemental Agreement No. I to "City of Round Rock Agreement for Purchase and Installation of Sus Shelters with Tolar Manufacturing Company, Inc.," hereinafter called the "Supplemental Agreement No. I," is made by and between the CITY OF ROUND ROCK, TEXAS, a Texas home -rule municipality, whose offices are located at 221 Fast Main Street, Round Rock, Texas 78664-5299, hereinafter called "City," and TOLAR MANUFACTURING COMPANY, INC. whose offices are located at 258 Mariah Circle, Corona, California 92879, hereinafter called "Vendor." WHEREAS, City and Vendor (collectively the "parties") executed an "Agreement for Purchase and Installation of Bus Shelters," hereinafter called the "Agreement" on June 24, 2021 by Resolution No. 2021-166; and WHEREAS, the parties desire to increase the original contract amount of $87,050.00 by an additional $6,535.00 for costs associated with additional site work; NOW THEREFORE, premises considered, and in consideration of the mutual promises and obligations in the Agreement and this Supplemental Agreement No. 1, the City and Vendor agree as follows: I. Section 5.01 Contract Amount is amended to read as follows: In consideration for the deliverables and services related to the deliverables, the City agrees to pay Vendor Ninety -Three Thousand Five Hundred Eighty -Five and No/100 Dollars ($93,585.00) for the goods and services set forth in Exhibit "A." 00485034/ss2 This Supplemental Agreement No. I shall extend the original Agreement as to time and costs only as set forth herein, with no other changes in terms or conditions of the original Agreement. After meeting with the designers to determine where to place the bus shelters, the bus shelter concrete pads were poured. The one pad located at 1001 Mays Street was built to follow the slope of the road in that location. Unfortunately after pouring the slab, it was determined that the cross slope of the pad was too steep to meet ADA requirements. To correct this situation, a new pad was poured behind the sidewalk in a flat area with just enough slope for drainage that would meet the 2% cross slope requirement for ADA compliance. The costs for the new concrete pad is $6,535,00 that when added to the original contract price of $87,050.00 brings the new total for the project to $93,585.00.
