6 FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
7 ORDINANCES AND RESOLUTIONS.

9 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
10 TEXAS:
11 I.
12 That Chapter 32, Article II, Section 32-23 of the Code of Ordinances (2018 Edition),
13 City of Round Rock, Texas, is hereby amended as follows:
14 Sec. 32-23. - Nonresidential refuse.
15 (a) Containers. For nonresidential customers, the city's contractor shall provide containers suitable for
16 dumping by mechanical means. Non-residential customers include all commercial and industrial
17 businesses, institutional and governmental entities, and multi-unit residential complexes located within
18 the City. Containers will be placed on private premises at locations agreed between the owner or
19 occupant and the city's contractor; provided, however, no such container shall be placed: 1)within 15
20 feet of the boundary of any abutting property with a SF (Single-family) or TF (Two-family) zoning
21 designation; or 2) in any front, rear or side yard abutting to a street. The city will not be responsible for
22 damages to paved surfaces on private property caused by commercial refuse collection trucks.
23 Sufficient containers will be placed to accommodate the refuse from each nonresidential customer.
24 Adjacent small businesses may share containers.
25 (b) Manner of disposal. All refuse from non-residential establishments shall be placed in the containers.
26 No refuse shall be left outside the containers.All garbage shall be drained before placing in containers.
27 All packing boxes larger than two cubic feet must be flattened before placing in containers. No manure,
28 building materials, rocks, dirt or dead animals shall be placed in the containers.
29 (c) Collection. The city's contractor will collect refuse on a schedule agreed upon between the contractor
30 and the nonresidential customer. Refuse containers shall not be placed out for collection earlier than
31 5:00 p.m. on the business day prior to the established collection day and shall be moved from the
32 collection site no later than 7:00 a.m. the day after the collection day. For the purposes of this section,
33 a business day shall be defined as any day the City of Round Rock offices are open for business.
34 (d) Recycling containers. The requirements in subsections (a), (b) and (c) of this section pertaining to
35 refuse containers shall also apply to recycling containers.
36 (e) This section shall not apply to nonresidential customers in the downtown commercial district as defined
37 in subsection 32-33(c).

2 Edition), City of Round Rock, Texas, is hereby amended as follows:
3 Sec. 32-28.-Garbage collection service charges.
4 (b) Nonresidential. A sanitation charge for the collection of refuse for all nonresidential customers shall
5 be made by the city's contractor. The charge shall include furnishing containers for refuse. This
6 subsection (b) shall exclude all businesses located within the downtown commercial district
7 described in subsection (c) below. The sanitation charges for nonresidential customers as set forth
8 below. The rates set forth below do not include any city franchise fees that may be passed through
9 to nonresidential customers and taxes imposed directly upon any nonresidential customers by the
10 state, city, or other governmental unit and collected by the city's contractor.

2 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are

4 B. The invalidity of any section or provision of this ordinance shall not
5 invalidate other sections or provisions thereof.
6 C. The City Council hereby finds and declares that written notice of the date,
7 hour, place and subject of the meeting at which this Ordinance was adopted was posted
s and that such meeting was open to the public as required by law at all times during which
9 this Ordinance and the subject matter hereof were discussed, considered and formally
10 acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government
11 Code, as amended.
