That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the Counties
of Travis and Williamson, State of Texas ("Releasor"), with mailing address of 221 East Main Street, Round
Rock, Texas 78664, for and in consideration of the sum of Ten and No' 100 Dollars ($ I0,00) and other good
and valuable consideration paid by AVERY RANCH COMPANY, LTD., a Texas limited partnership,
whose address is 400 East Main Street, Round Rock, Texas 78664, the receipt and sufficiency of which is
hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE a portion of the Water Line
Easement recorded as Document No. 2007038408 of the Official Public Records of Williamson County,
Texas, encumbering the below -described property, to -wit:
Being 0.067 acre, or 2,920 square foot, tract of land situated in the Willis Donaho Jr.
Survey, Abstract No. 173, in Williamson County, Texas, being out of a remnant portion
of a parcel two tract 1, a remnant portion of a called 1200.19 acres, conveyed to Avery
Ranch Company, Ltd., in Trustee Distribution Deed, recorded in Document No
2002071336 of the Official Public Records of Williamson County, Texas, and being a
portion of a Water Line Easement, Tract "C", to the City of Round Rock recorded in
Document No. 2007038408 of said Official Public Records; said 0.067 acre of land to be
more fully described by Metes and Bounds and sketch attached hereto as Exhibit "A" and
incorporated herein by reference for all purposes.
This instrument is given specifically to release the described said portion of the easement to the
extent Releasor is Grantee of said easement, which easement is partially terminated by abandonment,
termination, vacation, and cessation of purpose, and which portion of said easement will be of no further
effect, whether legal or equitable.
