That the CITY OF ROUND ROCK, TEXAS, a municipal corporation situated in the Counties
of Travis and Williamson, State ofTexas ("Releasor"), with mailing address of 221 East Main Street, Round
Rock, Texas 78664, for and in consideration of the sum of Ten and No/100 Dollars ($10.00) and other good
and valuable consideration paid by NEC 1460/79, LTD., a Texas limited partnership, whose address is
4200 North Lamar Boulevard, Suite 200, Austin, Texas 78756, the receipt and sufficiency of which is
hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE a portion of the Drainage
Easement recorded as Document No. 2005092576 of the Official Public Records of Williamson County,
Texas, encumbering the below -described property, to -wit:
All that certain lot, tract or parcel of land situated in the P.A. Holder Survey, Abstract
No. 297 in Williamson County, Texas, and being a portion of a Drainage Easement
recorded under Document No. 2005092576, Official Public Records of Williamson
County, Texas, and also being a part of the reminder of a 37.975 acre tract of land
described in Deed to NEC 1460/79, Ltd., a Texas limited partnership and recorded in
Instrument Number 2006040139 of the Official Public Records of Williamson County,
Texas, and being more fully described by Metes and Bounds and sketch attached hereto
as Exhibit "A" and incorporated herein by reference for all purposes.
This instrument is given specifically to release the described said portion of the easement to the
extent Releasor is Grantee of said easement, which easement is partially terminated by abandonment,
termination, vacation, and cessation of purpose, and which portion of said easement will be of no further
effect, whether legal or equitable.
