KNOW ALL BY THESE PRESENTS:
This Supplemental Agreement No. 1 to "City of Round Rock Agreement for the Purchase
of Maintenance, Repair and Operating Supplies and Services," hereinafter called the
"Supplemental Agreement No. I," is made by and between the CITY OF ROUND ROCK,
TEXAS, a Texas home -rule municipality, whose offices are located at 221 East Main Street,
Round Rock, Texas 78664-5299, hereinafter called "City," and HOME DEPOT U.S.A., INC.,
whose offices are located at 2455 Paces Ferry Road, NW, Atlanta, Georgia 30339 hereinafter
called "Services Provider."
WHEREAS, City and Services Provider executed an "Agreement for the Purchase of
Maintenance, Repair, and Operating Supplies and Services," hereinafter called the "Agreement"
on June 14, 2018; and
WHEREAS, the parties desire to add an additional Thirty Thousand and No/100 Dollars
($30,000.00) of costs to the Agreement for the remaining term of the Agreement as set forth
herein;
NOW THEREFORE, premises considered, and in consideration of the mutual promises
and obligations in the Agreement and this Supplemental Agreement No. 1, the City and Services
Provider agree as follows:
I.
Section 4.0, Costs, Paragraph B is amended to read as follows:
B. The City shall be authorized to pay the Services Provider an amount not to exceed
Two Hundred Thousand and No/100 Dollars ($200,000.00) per year for the term of this
Agreement, plus an additional Thirty Thousand and No/100 Dollars ($30,000.00) added by this
Supplemental Agreement No. 1. This amount will be managed solely by the City.

This Supplemental Agreement No. I shall extend the original Agreement as to time and
costs only as set forth herein, with no other changes in terms or conditions of the original
Agreement.

Consider executing Supplemental Agreement No. 1 "City of Round Rock Agreement for the Purchase of
Maintenance, Repair and Operating Supplies and Services with Home Depot U.S.A. Inc." The current
agreement with Home Depot was executed in June 2018 and authorizes the City to pay an amount not to
exceed $200,000 per year. The service agreement with Home Depot has been very successful - to the point
that this calendar year, expenditures have tracked to exceed the $200,000 allowance by the end of
December. Increased activity this calendar year is attributable to enhanced online ordering with quote
options, discounts related to bulk purchases and some significant purchases for the training center by Fire
Logistics.
The amendment to increase the amount by $30,000 will sufficiently cover needs through the end of the
calendar year. The City Manager is authorized to execute this supplemental agreement under the City of
Round Rock's Code of Ordinances, Section 2-326, part (c)(2).
The City's current contract with Home Depot will terminate on December 31, 2021 as documented in the
original contract. The purchasing team is currently working on a new master agreement with Home Depot
that will cover transactions beginning in January 2022.
