4 AN ORDINANCE AMENDING ZONING AND DEVELOPMENT CODE,
5 CHAPTER 2, ARTICLE VI11, CODE OF ORDINANCES (2018 EDITION),
6 BY ADDING SECTION 2-100 REGARDING RECYCLING
7 REQUIREMENTS, CITY OF ROUND ROCK, TEXAS, AND PROVIDING
8 FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
9 ORDINANCES AND RESOLUTIONS.

11 WHEREAS, currently the City of Round Rock, Texas, provides recycling services
12 for all persons owning, managing, operating, leasing, or renting any residential
13 premises, excluding multi-family properties; and
14 WHEREAS, the City's goal is to increase all residents' access to recycling
15 services; and
16 WHEREAS, consistent with this goal, the City desires to require owners and
17 managers of new multi-family developments to provide recycling services to its tenants;
18 Now Therefore,
19 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
20 TEXAS:

22 That Zoning and Development Code, Chapter 2, Article Vlll, Code of Ordinances
23 (2018 Edition), City of Round Rock, Texas, is hereby amended by adding Section 2-100
24 as follows:
25 CHAPTER 2.ZONING DISTRICTS AND USE REGULATIONS
26 Sec. 2-100.—Recycling for multifamily developments.
27 (a) Purpose and intent. The purpose of this section is to establish recycling collection requirements for
28 new multifamily developments as set forth in (b)below.
29 (b) Applicability. This section shall apply to new multifamily developments within any zoning district with
30 a minimum of eight (8) units contained within one building.

1 (c) Requirements. The owner or manager shall implement and provide continuous recycling collecCon
2 services in a centralized location in accordance with this section. Prior to receiving a site
3 development permit, the owner or property manager of the development shall indicate the following
4 on the site development plan:
5 (1) The location of recycling collection facilities; and
6 (2) The screening for all recycling dumpsters and receptacles as required by section 8-40(a)(3).

9 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
10 expressly repealed.
11 B. The invalidity of any section or provision of this ordinance shall not
12 invalidate other sections or provisions thereof.
13 C. The City Council hereby finds and declares that written notice of the date,
14 hour, place and subject of the meeting at which this Ordinance was adopted was posted
15 and that such meeting was open to the public as required by law at all times during
16 which this Ordinance and the subject matter hereof were discussed, considered and
17 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
18 Government Code, as amended.

21 Council members present, the requirement for reading this ordinance on two separate
22 days was dispensed with.
