("Engineer") ADDRESS: 710 Hesters Crossing, Suite 150, Round Rock,, TX 78681 PROJECT: UPRR Quiet Zone Diagnostics This Supplemental Contract No. I to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and HDR Engineering, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 7th day of May, 2021 for the UPRR Quiet Zone Diagnostics Project in the amount of $12,51 1.80; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $16,928.52 to a total of $29,440.32; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: Article 1, City Services and Exhibit A, City Services shall be amended as set forth in the attached Addendum To Exhibit A. Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. Article 4, Compensation and Exhibit D,_Fee Schedule shall be amended by increasing by $16,928.52 the lump sum amount payable under the Contract for a total of $29,440.32, as shown by the attached Addendum to Exhibit D. Designate a Project Manager to represent the CITY, B. Any records available which would assist in the completion of quiet zone process. C. Review and feedback of recommendations offered by the ENGINEER. D. Review of progress of work and final acceptance of all documents. E. Processing of all periodic payment requests submitted by ENGINEER. F. Submittal of documentation to regulatory agencies for review, comment, or approval when specified. G. Provide the ENGINEER with timely reviews and decisions necessary for the ENGINEER to maintain the project work schedule. City of Round Rock Page 1 of 1 Exhibit A ADDENDUM TO EXHIBIT B Engineering Services City of Round Rock — UPRR Quiet Zone Application The work to be performed by HDR Engineering, Inc. (ENGINEER) shall consist of providing engineering services for Quiet Zone Application for Harrell Parkway (972310C) and Brushy Creek (439682D). CONTRACT CONSTRAINTS AND CONDITIONS Per the Diagnostic Review Meeting minutes, Harrell Parkway and Brushy Creek will be submitted as a separate quiet zone using Alternate Safety Measures. The Private at -grade crossing to the west will not be included in this proposed quiet zone or as an amendment to the existing quiet zone to the west. EXCLUSIONS The following items are excluded as part of the diagnostics. A. Any PS&E development or Exhibits SCOPE OF SERVICES I. QUIET ZONE APPLICATION A. Preparation of the following documentation for the City to submit to FRA, TxDOT, and UPRR as part of the quiet zone development process: City of Round Rock Page 1 of 2 Exhibit B • Notice of Intent (NOI) • Reponses to NOI (if any required) • Quiet Zone Application: including any supporting documentation • Notice of Establishment (NOE) • NOI and NOE documents will be sent to City for official mailing. HDR will follow-up with each recipient via email to verify they received. B. Utilize as-builts or original design plans for Harrell Parkway and Brushy Creek crossings for exhibits. Deliverables: A. Quiet Zone NOI and NOE II. PROJECT MANAGEMENT A. Perform general Project Management during the course of the project to include coordination with the CITY and invoices. (Assumed 12 months project schedule and six (6) invoices.) B. Preparation of project correspondence including reports, record keeping, and letters as necessary. C. Perform QA/QC of deliverables prior to submittal to the CITY. Implement a documented QAIQC program in accordance with the ENGINEER's established procedures. D. Attend project coordination meeting via teleconference with the CITY and FRA/TxDOT1UPRR as needed. Six (6) virtual meetings are assumed for coordination with various agencies. This will include the crossing at Harrell Parkway, Brushy Creek Plant Road and the private crossing. Union Pacific Railroad has given us a contract to execute and an estimate for the work to be performed by UPRR. This will include the NOI review, Field Diagnostic, Application review, NOE review, and Grade Crossing inventory. The cost for these services was $12,511.80 Supplement #1 is for continued engineering services per the Diagnostic Review Meeting minutes, Harrell Parkway and Brushy Creek will be submitted as a separate quiet zone using Alternate Safety Measures. The Private at -grade crossing to the west will not be included in this proposed quiet zone or as an amendment to the existing quiet zone to the west. The engineers will be responsible for continued railroad coordination, writing the NOI (Notice of Intent), and the NOE (Notice of Establishment) construction management and as -built drawings. The total for these services is $16,928.52. The total contract price is then $29,440.32.
