WHEREAS, Zoning and Development Code, Chapter 8, Article III, Sec. 8.18, Code of
Ordinances (2018 Edition), designates certain trees in the City as Monarch Trees; and
WHEREAS, Monarch Trees are protected and may not be removed unless the monarch
designation is removed by the City Council; and
WHEREAS, Esterly Schneider Associates, Inc. has submitted a request to remove the monarch
designation for two trees located on the proposed development site at 301 N. A.W. Grimes Boulevard,
as described on Exhibit "A," Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the monarch designation for the two Monarch Trees located on the site of the proposed
development site at 301 N. A.W. Grimes Boulevard, as described on Exhibit "A," is hereby removed.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

The following letter is a formal request pursuant to Section 8-18 (d) 4 of the Round Rock, TX Code of Ordinances. We request
City Council to remove the designation of the Monarch Trees, indicated as M-200-10 and M-200-19 on the included site plan
submittal, both of which are 36" Live Oaks. Every effort to preserve the indicated trees has been explored since this projects
initial submittal made to the City of Round Rock in June of 2016.
After receiving our first round of comments in July of 2016, we revised the site plans and resubmitted for the second review. In
April of 2017, after review comments from the City, multiple conversations between City staff and the design team, and a site
visit by the Planner to inspect the Monarch trees in question, another revised site was designed. During this time it was
discovered that work had been done on the property by someone other than O'Reilly.
Sometime after June 2016, a new 8" looped water main was installed that cuts through and wraps around the O'Reilly lot,
impacting tree M-200-10, and an access drive was installed. This drive is a shared drive, encroaching 15' onto the O'Reilly
property and also impacting tree M-200-10's enhanced critical root zone by almost 12'. A new revised set was submitted in
October of 2018, which reflected the updated existing conditions, along with coordination with the City, protecting the
M-200-10 and 19 trees. During our second pre -submittal meeting for this site, we received the meeting minutes from the pre -
submittal meeting on November 8, 2018. The Landscape comments included the requirement for a 'Tree Survey' as part of
the pre -submittal. A new tree survey was coordinated by our landscape architect and Inland Geodetics, LLC and was
completed in May of 2019, revealing additional monarch trees on the North side of the property. After another round of
extensive coordination with the Owner and the City, another site design was submitted in December of 2019. Comments
provided by the City on January 6, 2020 Indicate additional hindrances to the development of this site, including the required
15' of clearance for the building from the existing waterline mentioned above. Parking requires landscape islands at each end,
and those islands require 3" trees which cannot be in the utility easement for the waterline. With these new obstacles, a
conference call between the City, the Owner and the design team was held on June 23, 2020. In this call, we discussed the
options available with the limitations to the site. As a result, the conclusion was reached that a site plan showing two southern
Monarch trees being removed should be submitted for consideration by staff and with the objective to approach City Council.
This plan was submitted on June 25, 2020. Unfortunately, while trying to get City staff approval to proceed with the updated
site plan, the original reviewer retired.
The parcel is 73,853 s.f. After the total area is reduced by shared drives, and by the Monarch trees enhanced critical root
zones, approximately 29,200 s.f. would be available for development. This area will not allow for the installation of the
10,168 s.f. building along with the required parking areas, new landscape and detention basin, which would allow O'Reilly
Auto Parts to effectively use this lot.
Without the change in designation, the site cannot meet the Owner's development needs, neither the enhanced requirements
of this area, nor the general minimum requirements for basic operations for this O'Reilly Auto Parts Store.
