Dear Ms. Hadley and Attorney Sheets,
I am delighted to be retained by the City of Round Rock to provide assistance in
connection with your Texas matter. It is my practice in opening matters for new clients to
provide an engagement letterin order to confirm the terms and conditions under which I
will render my services.
My hourly fee is $875. However, because of Doug Sigel's involvement I will honor a
concessionary fee of $825/hour. This fee applies to all time spent traveling (portal to
portal). The fee applies uniformly to all work performed.
Without approval by the City, my fees will not exceed $40,000. Should I approach
that amount, the City and I will discuss what action should be taken.
In addition to my fees, I bill for all costs and expenses incurred, such as overnight delivery,
travel, lodging, meals, ground transportation, and parking and the like provided these are
customary and reasonable.
Because of the vagaries of litigation, I book all travel using refundable tickets.
Furthermore, because of the need to work and arrive rested, in the case of a trial or
deposition I book the outbound leg of such travel in business class, or if business class is
not available, the next higher class. The return leg is booked using economy class unless a
higher class is available at little additional cost.
My expenses will be billed consistent with Section 274(d) of the Internal Revenue Code.
Accordingly, any reimbursement will not be reported by you to the Internal Revenue
Service on form 1099 as compensation.
I am mindful of the costs of legal services; accordingly, I will seek at all times to handle
your matter as efficiently and effectively as possible without sacrificing the quality of my
services. I do not mark up any out-of-pocket expenses, do not charge for office
administration, do not levy any fee for overhead, do not charge for the cost of sending or
receiving faxes, and do not charge for the cost of access to any computer data bases.
When I complete the services for this engagement, we will consider our engagement to be
terminated. I will be fi•ee to work for other clients, even if they might be viewed as having
adverse interests to yours in matters outside of this engagement.
If these terms are satisfactory, please return a signed copy of this engagement letter either
by email or in hard copy.
