WHEREAS, the City of Round Rock desires to use a portion of the City Property for

Rock makes the following Declaration of a Wastewater Easement:

(hereinafter called the "Declarant") has executed this Declaration of a Wastewater Easement fim
the purpose of establishing the following exclusive easement in and under the followi

Being a description of a 0.262 acre of land (approx. 11,422 square feet), being out
of and a portion of P.A.Holder Abstract No.• •County,
also being a portion of a' • 2, Block C of Resort and Replat of
Bertil der Subdivision,subdivision of record in Document No.

The perpetual easement, right-of-way, rights and privileges herein granted shall be used
to construct, install, operate, maintain, inspect, reconstruct, enlarge, relocate, rebuild, repair, and
remove a water distribution system and water lines, together with all necessary lines, pipes,
conduits, valves, vaults, manholes,• and other equipment,• a • -
and appurtenances or operations and any other necessary accessories thereto.

Declarant retains, reserves, and shall continue to enjoy the surface of such easement for
any and all purposes which do not interfere with and prevent the use of the easement. Declarant
will not be res.consible or liable for anp I tilitie
Declarant's use of the surface pursuant to this paragraph.
Except as otherwise stated, the easement and other rights and privileges hereby created
shall be perpetual. However, it is expressly provided that this Declaration may be modified,
amended, or terminated by Declarant at any time, and without any condition, requirement or
prerequisite to same.
The benefits and obligations of the easement created herein shall constitute benefits and
servitudes running with the land.
