4 AN ORDINANCE AMENDING ZONING AND DEVELOPMENT CODE,
5 CHAPTER 8, ARTICLE II, SECTION 8-10, CODE OF ORDINANCES
6 (2018 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING
7 IRRIGATION SYSTEMS; AND PROVIDING FOR A SAVINGS CLAUSE
8 AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS.

10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
11 TEXAS:
12 I.
13 That Zoning and Development Code, Chapter 8, Article II, Section 8-10(i), Code
14 of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended to read as
15 follows:
16 ARTICLE II. - LANDSCAPING
17 Sec. 8-10. - Landscaping.
18 (i) Irrigation.
19 (1) Underground automatic system. All required landscape areas shall be irrigated
20 by an underground automatic system that may include a drip irrigation system.
21 This system shall adhere to manufacturer specifications and the rules and
22 regulations established by TCEQ or successor agency. In addition, an irrigation
23 system must be designed by a landscape architect or irrigator licensed by the
24 state as described in subsection (3) below.
25 (2) System requirements. An irrigation system shall comply with the following:
26 a. Sprinkler head spacing shall be designed for head-to-head coverage and
27 adjusted for prevailing winds. The system shall promote minimum runoff
28 and minimum overspray onto non-irrigated areas (i.e., paving, walkway,
29 buildings).
30 b. Sprinkler heads shall have matched precipitation rates within each control
31 valve circuit.
32 C. Adjustable flow controls shall be required on circuit remote control valves.
33 Pressure regulation components shall be required where static pressure
34 exceeds manufacturer's recommended operating range.
35 d. Valves and circuits shall be separated based on water use requirements,
36 so that turf areas can be watered separately from shrubs, trees and
37 groundcover areas. A minimum of one bubbler each shall be provided for
38 all large and medium size trees, except 4" caliper or larger trees shall
39 have a minimum of two (2) bubblers.
40 e. Serviceable check valves shall be required where elevation differential
41 may cause low head drainage adjacent to paving areas.
42 f. All automatic irrigation systems shall be equipped with an electronic
43 controller capable of dual or multiple programming. Controller(s) shall
44 have multiple cycle start capacity and a flexible calendar program,
45 including the capability of being set to water every five (5) days.

1 g. All automatic irrigation systems shall be equipped with a rain and freeze
2 sensor shut-off device that will automatically shut down the irrigation
3 system when the ambient temperature falls below 40 degrees Fahrenheit.
4 h. Drip irrigation shall have flag heads at the end of the drip tubing.
5 i. Irrigation systems must be inspected at least once every three years by
6 an inspector who holds a license in compliance with the below subsection
7 (3) License requirements. The results of the inspection shall be submitted
8 to the Utilities & Environmental Services Director within 30 days following
9 the inspection. This requirement shall not apply to irrigation systems
10 installed on residential properties in the SF-R (Single-Family — Rural);
11 SF-1 (Single-Family — Large Lot); SF-2 (Single-Family - Standard Lot);
12 SF-3 (Single-Family — Mixed Lot); SF-D (Single-Family — Downtown);
13 and TF (Two-Family) zoning districts.
14 (3) License requirements.
15 a. Any person who connects an irrigation system to the water supply within
16 the city or the city's extraterritorial jurisdiction must hold a valid license, as
17 defined by 30 Tex. Admin. Code ch. 30 and required by V.T.C.A.,
18 Occupations Code ch. 1903, or as defined by 22 Tex. Admin. Code ch.
19 365 and required by V.T.C.A., Occupations Code ch. 1301.
20 b. A property owner is not required to be licensed in accordance with
21 V.T.C.A., Occupations Code, § 1903.002(c)(1) if he is performing
22 irrigation work in a building or on premises owned or occupied by the
23 person as the person's home. A home or property owner who installs an
24 irrigation system must meet the standards contained in 30 Tex. Admin.
25 Code ch. 344 regarding spacing, water pressure, spraying water over
26 impervious materials, rain or moisture shut-off devices or other
27 technology, backflow prevention and isolation valves. See V.T.C.A.,
28 Occupations Code § 1903.002 for other exemptions to the licensing
29 requirement.
30 (4) Permit required.
31 a. Any person installing an irrigation system within the city limits or
32 extraterritorial jurisdiction is required to obtain a permit from the city. Any
33 irrigation plan approved for a permit must be in compliance with the
34 requirements of 30 Tex. Admin. Code ch. 344.
35 b. Exemptions.
36 1. An irrigation system that is an on-site sewage disposal system,
37 such as gray water irrigation, as defined by V.T.C.A., Health and
38 Safety; or
39 2. An irrigation system used on or by an agricultural operation as
40 defined by V.T.C.A., Agriculture Code § 251.002.
41 C. The city building inspections department shall be responsible for issuing
42 irrigation system permits and collecting fees. To obtain a permit an
43 applicant must submit a plan, complete an application provided by the
44 department, and pay the applicable fee.
45 (5) Water conservation. All irrigation systems shall be designed, installed,
46 maintained, altered, repaired, serviced, and operated in a manner that will
47 promote water conservation.
48 (6) Design, installation and operation. V.T.C.A., Occupations Code § 1903.053
49 (standards), and 30 Tex. Admin. Code ch. 344, as amended, are hereby
50 incorporated by reference as the minimum standards and specifications for
51 designing, installing, and operating an irrigation system within the city or the city's
52 extraterritorial jurisdiction.
1 (7) Items not covered by the subsection. Any item not covered by this subsection
2 and required by law shall be governed by V.T.C.A., Occupations Code, V.T.C.A.,
3 Water Code, 30 Tex. Admin. Code, and any other applicable state statute or
4 Texas Commission on Environmental Quality rule.
5 (8) Fees. The fees for obtaining and renewing an irrigation permit may be found
6 in Sec. 8-106. These fees will be in amounts sufficient to cover the city's costs in
7 issuing and renewing the permits, including but not limited to staff time and other
8 overhead costs.
9 (9) Enforcement.
to a. The city shall have the power to administer and enforce the provisions of
11 this subsection as may be required by governing law. Any person, firm,
12 corporation or agent who shall violate a provision of this Code, or fails to
13 comply therewith, or with any of the requirements thereof, is subject to
14 suit for injunctive relief as well as prosecution for criminal violations. Any
15 violation of this subsection is declared to be a nuisance.
16 b. Nothing in this subsection shall be construed as a waiver of the city's right
17 to bring a civil action to enforce the provisions of this subsection and to
18 seek remedies as allowed by law, including but not limited to the
19 following:
20 1. Injunctive relief to prevent specific conduct that violates the
21 subsection or to require specific conduct that is necessary for
22 compliance with the subsection; and
23 2. Other available relief.

26 II.

28 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
29 expressly repealed.
30 B. The invalidity of any section or provision of this ordinance shall not
31 invalidate other sections or provisions thereof.
32 C. The City Council hereby finds and declares that written notice of the date,
33 hour, place and subject of the meeting at which this Ordinance was adopted was posted
34 and that such meeting was open to the public as required by law at all times during
35 which this Ordinance and the subject matter hereof were discussed, considered and
36 formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas
37 Government Code, as amended.
