KNOW ALL BY THESE PRESENTS:
This Supplemental Agreement No. 1 to "City of Round Rock Agreement for Professional
Consulting Services related to Waterline Leak Detection with NRW Consulting Services, Inc.
(d!b,'a/ JBS Associates)," hereinafter called the "Supplemental Agreement No. 1," is made by
and between the CITY OF ROUND ROCK, TEXAS, a Texas home -rule municipality, whose
offices are located at 221 East Main Street, Round Rock, Texas 78664-5299, hereinafter called
"City," and NRW CONSULTING SERVICES, INC. (d,b!a JBS Associates), whose offices are
located at 8106 Yaupon Drive, Austin, Texas 78759, hereinafter called "Consultant."
WHEREAS, City and Consultant executed an "Agreement for Professional Consulting
Services related to Waterline Leak Detection," hereinafter called the "Agreement" on October 9,
2020; and
WHEREAS, the Agreement states that the total amount of costs to be paid to Consultant
shall not exceed $40,000.00 for the term of the Agreement; and
WHEREAS, the parties desire to increase the Contract Amount by an additional
S7,500.00 as set forth herein;
NOW THEREFORE, premises considered, and in consideration of the mutual promises
and obligations in the Agreement and this Supplemental Agreement No. 1, the City and
Consultant agree as follows:
I.
Section 5.0, Contract Amount, is amended to read as follows:
Fee: City agrees to pay Consultant as set forth in Exhibit "D," "Fee Schedule,'' which
document is attached hereto and incorporated herein by reference for all purposes, in payment
for services delineated in Exhibit "B." 1

Not -To -Exceed Amount: The fees paid by the City to Consultant over the term of the
Agreement shall not exceed Forty -Seven Thousand Five Hundred and No/100 Dollars
($47,500.00).
Reimbursable Expenses: Reimbursable expenses shall not be included in this Agreement.
II.
This Supplemental Agreement No. 1 shall extend the original Agreement as to costs only
as set forth herein, with no other changes in terms or conditions of the original Agreement.
IN WITNESS WHEREOF, the City and Consultant have executed this Supplemental
Agreement No. 1 to be effective as of the last date of due execution by both parties.

In October 2020, the Utility & Environmental Services Department entered into a two-year agreement with
NRW Consulting Services, dba AS Associates (JBS) for $40,000. JBS provides leak detection services to the
department that has helped the Water Distribution Division find sources of low pressure and leaks
throughout the City. These leak detection services helps protect infrastructure and mitigate issues before
they become large-scale problems.
As we have experienced over the past year, inflation has increased the cost of many goods and services
that the City receives. The current agreement with JBS expires at the end of fiscal year 2022; however, the
final invoice exceeds the contract limit. The department requests a contract increase of $7,500 for a new
not -to -exceed amount of $47,500.
