AN ORDINANCE AMENDING THE "ZONING ORDINANCE"
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE
CITY OF ROUND ROCK, TEXAS, ON THE 7TH DAY OF
OCTOBER, 1976, AMENDING THE ZONING ORDINANCE
MAP AND MAKING THIS AMENDMENT A PART OF THE
MAP OF THE ORIGINAL ORDINANCE: TO CHANGE 7.06
ACRES OUT OF THE WILEY HARRIS SURVEY, ABSTRACT
NO. 298, AND BEING THE SAME TRACT CONVEYED FROM
E. ROTHLISBERGER TO R. L. EGGER, BY DEED AND RE-
CORDED IN VOLUME 259, PAGE 259, DEED RECORDS,
WILLIAMSON COUNTY, TEXAS, AS DESCRIBED BELOW
FROM "R -1" SINGLE FAMILY RESIDENTIAL DISTRICT
TO "B -1" GENERAL BUSINESS DISTRICT, AS HEREIN-
AFTER SET FORTH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS:
WHEREAS, an application has been made to the City Council
for the purpose of amending the Zoning Ordinance from "R -1" Single
Family Residential District to "B -1" General Business District on
the following described real property, to -wit:
A tract of 7.06 acres situated upon the Wiley Harris
Survey, Abstract No. 298 in Williamson County, Texas;
and also being out of and a part of a tract described
as containing 122.82 acres in a deed from E. Rothlis-
berger to R. L. Egger, recorded in Volume 259, Page 259,
Deed Records of Williamson County, Texas.
Beginning at a steel stake in the west line of Cushing
Street in the City of Round Rock, Texas; which point is
the N.W. corner of Egger's Southview Addition to said
city, a plat of which addition is of record in Volume
4, Page 75, Plat Records of Williamson County, Texas.
Thence along the north fence of Southview Addition, N.
76° 22' W. 252.31 feet, and N. 0° 16' W. 1.1 feet to a
steel stake in the east right -of -way line of U. S. High-
way 81; the S.W. corner hereof.
Thence along said east right -of -way line of Highway 81,
N. 5° 25' E. 184.25 feet to a steel stake at the N.W.
corner of a 30 -foot wide drainage tract taken by the
State of Texas in condemnation proceedings on March 13,
1934, the record of which is in Volume 6, Page 295,
Civil Minutes in County Court of Williamson County,
Texas.
Thence around said State tract as follows: S. 27° 23'
E. 70.77 feet; N. 62° 37' E. 30 feet; and N. 27° 23'
W. 140.17 feet to a steel stake placed in the east line
of said Highway 81.
Thence again with said Highway east line, N. 6° 54' 30"
W. 114.98 feet to a concrete highway marker 50 feet dist-
ant and opposite Highway Station 72 plus 71.8; said
point also being at the beginning of a 1° curve to the
left in said east right -of -way line.
AND WHEREAS, the City Council has submitted the proposed
change in the Zoning Ordinance to the City Planning and Zoning Com-
mission for its recommendation and report; and
WHEREAS, the City Planning and Zoning Commission has ap-
proved the changing of said Zoning Ordinance on the above - described
property from "R -1" Single Family Residential District to "B -1"
General Business District, after holding a public hearing thereon
the 23rd day of September, 1976; and
WHEREAS, each and every requirement set forth in the Zoning
Ordinance concerning notices, hearing and other procedural matters
have been fully complied with; and
WHEREAS, the City Planning and Zoning Commission approved
the change aforesaid in the Ordinance; said approval being given
by said Commission on the 23rd day of September, 1976.
NOW, THEREFORE, be it resolved by the City Council of the
City of Round Rock, Texas, that the Zoning Ordinance and the zon-
ing map of the City of Round Rock, Texas be amended so that the
property above described shall be and the same is hereby removed
from "R -1" Single Family Residential District to "B -1" General
Business District.
READ, PASSED and ADOPTED this day of
1976.
Thence with said east right -of -way line, an arc distance
of 810.92 feet to a steel stake placed for the N.W. corn-
er hereof. The radius of this curve is 5779.28 feet; the
central angle is 8° 2' 19 "; and the long chord of same
bears N. 4° 17' W. 810.21 feet.
Thence along the south line of a 2.00 -acre tract conveyed
by Stella Egger to Virgil Rabb by deed recorded in Volume
623, Page 536, Deed Records of Williamson County, Texas;
S. 76° 50' E. 323.21 feet to a steel stake in the west
line of Cushing Street; which point is the S.E. corner
of said Rabb tract and it is the N.E. corner hereof.
Thence along the west line of Cushing Street, due south
402.78 feet, a steel stake; S. 1° 9' 30" E. 351.38 feet,
a steel stake; and S. 2° W. 414.0 feet along an old fence,
to the place of beginning, containing 7.06 acres;
