O-77-446 - 11/10/1977ORDINANCE NO. </4i AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, AMENDING THE ZONING ORDINANCE MAP AND MAKING THIS AMENDMENT A PART OF THE MAP OF THE ORIGINAL ORDINANCE: TO CHANGE A PARCEL OF LAND BEING 3.72 ACRES OUT OF THE WILEY HARRIS SURVEY, IN THE CITY OF ROUND ROCK, TEXAS, FROM R 1" SINGLE FAMILY TO "B -1" GENERA BUSINESS DISTRICT, AS HEREBY SET FORTH. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas for the purpose of amending the Zoning Ordinance from "R -1" Single Family District to "B -1" General Business District on the following described real property, to wit: FIELD NOTES FOR 3.72 ACRES OF LAND OUT OF THE WILEY HARRIS SURVEY. BEGINNING at the northwest corner of the herein described tract and being in the east R.O.W. of County Road No. 115, from which corner the northeast corner of the Wiley Harris Survey bears N 0° 09' W, a distance of 807.10 feet and N 1° 13' W, a distance of 2,945.00 feet; THENCE, S 75 49' E, a distance of 143.79 feet to an iron pin found; THENCE, S 0 09' E, a distance of 328.36 feet to an iron pin found; THENCE, S 81° 45' E, a distance of 319.53 feet to an iron pin found, said pin being in the west R.O.W. of Provident Lane; THENCE, following the west R.O.W. of Provident Lane, the following (3) three courses: 1) S 3 41' W, a distance of 59.03 feet to an iron pin found; 2) 225.66 feet along the arc of a curve to the right having a radius of 2,831.20 feet and a chord which bears S 5 58' W, a distance of 225.60 feet to an iron pin found; 3) 23.56 feet along the arc of a curve to the right having a radius of 15.00 feet and a chord which bears S 53 15' W, a distance of 21.21 feet to an iron pin found; THENCE, following the north R.O.W. of U. S. Highway 79, the following (2) two courses: 1) N 81 45' W, a distance of 265.00 feet to an iron pin found; 2) N 42 16' W, a distance of 220.88 feet to an iron pin found; THENCE, following the east R.O.W. of County Road No. 115, N 0° 10' W, a distance of 503.98 feet to the POINT OF BEGINNING containing 3.72 acres of land. 1 WHEREAS, the City Council has submitted the proposed change in the Zoning Ordinance to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the changing of said Zoning Ordinance on the above - described pro- perty from "R -1" Single Family District to "B -1" General Business District, after holding a public hearing thereon on the 3rd day of November, 1977, and the City Planning and Zoning Commission has approved and recommended to the City Council on the 3rd of Novem- ber, 1977, that the Zoning Ordinance be amended so that the above - described property be changed from "R -1" Single Family District to "B -1" General Business District; and WHEREAS, each and every requirement set forth in the Zoning Ordinance concerning notices, hearings, and other procedural mat- ters have been fully complied with: NOW, THEREFORE, be it resolved by the City Council of the City of Round Rock, Texas, that the Zoning Ordinance and the zoning map of the City of Round Rock, Texas be amended so that the property above - described shall be and the same is hereby removed from "R -1" Single Family District to "B -1" General Business District. (Mark through the following alternative that is not applicable) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with.
