O-77-451 - 12/8/1977ORDINANCE NO. , JJ AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS ON THE 2ND DAY OF OCTOBER, 1969, AMENDING THE ZONING ORDINANCE MAP AND MAKING THIS AMENDMENT A PART OF THE MAP OF THE ORIGINAL ORDINANCE: TO CHANGE TRACT ONE CONTAINING 1.57 ACRES OUT OF THE DAVID CURRY SURVEY AND THE WILEY HARRIS SURVEY IN WILLIAMSON COUNTY, TEXAS, AND TRACT TWO CONTAINING 8.268 ACRES OUT OF THE DAVID CURRY SURVEY AND THE WILEY HARRIS SURVEY IN WILLIAMSON COUNTY, TEXAS, AS DESCRIBED BELOW FROM "B -2" LOCAL BUSINESS DISTRICT TO "R -2" MULTI - FAMILY RESIDENTIAL DISTRICT, AS HEREINAFTER SET FORTH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of amending the Zoning Ordinance and the Zoning Ordinance Map from "B -2" Local Business District to "R -2" Multi- Family Residential District on the following described two tracts of real property, to -wit: TRACT ONE: Being a portion of that 23.61 acre tract of land conveyed to T. L. Wright, et al, in a deed recorded in Volume 670, Page 150 of the Deed Records of Williamson County, Texas, being 0.10 acres out of the David Curry Survey, Abstract No. 130, and 1.47 acres out of the Wiley Harris Survey, Abstract No. 298, being a total of 1.57 acres and being more particularly described by metes and bounds as follows: Beginning for a POINT OF REFERENCE at the Southeast corner of said David Curry Survey; THENCE S 71 °W, 6204 feet; N 21 51'W, 119.0 feet; and S 67° 02' 50 "W, 199.93 feet to an iron pin found at the Northwest corner of a 2.87 acre tract conveyed to J. Colley and B. Mince as described in a deed recorded in Volume 593, Page 671, of the Deed Records of Williamson County, Texas, and S 21° 54' 30 "E, 101.53 feet to an iron pin set for the TRUE POINT OF BEGINNING and the Northeast corner of this described tract; THENCE along the West line of said 2.87 acre tract, the East line hereof, S 21° 54' 30 "E, 568.03 feet to a point being the Southwest corner of said 2.87 acre tract, also being a point in the North line of a 1.37 acre tract conveyed to J. Colley, for the Southeast corner hereof; THENCE along the north line of said 1.37 acre tract, the South line hereof, S 43° 37' 30 "W, 102.92 feet to an iron pin found at the Eastern most corner of Lot 1, Block D, of Onion Creek Village, Section One, a subdivision of record, recorded in Cabinet C, Slide 381, of the Plat Records of Williamson County, Texas for the Southern most corner hereof; THENCE along and with the boundary line of said Onion Creek Village, Section One, a common line hereof, the following three (3) calls: 1.) N 58° 08' 30 "W, 114.32 feet to an iron pin found for a Point of Curvature; 2.) Along the arc of a curve to the left having elements of delta= 53 °46', rad.= 125.00 feet, tan. =63.37 feet, arc = 117.30 feet, chord and chord bearing of 113.04 feet and N 04° 58' 29 "E to an iron pin found for a Point of Tangency; 3.) N 21° 54' 30 "W, 417.62 feet to an iron pin found; THENCE N 68° 05' 30 "E, 110.13 feet to the TRUE POINT OF BEGINNING and containing 1.57 acres of land more or less. TRACT TWO: Being a portion of said 23.61 acre tract and being 1.331 acres out of said David Curry Survey and 6.937 acres out of said Wiley Harris Survey, a total of 8.268 acres and being more particularly described by metes and bounds as follows: Beginning for a POINT OF REFERENCE at the Southeast corner of said David Curry Survey; THENCE S 71 ° W, 6204 feet; 5 21° 51'E, 635.68 feet; and S43 03'W, 502.91 feet to an iron pin found at the Southernmostcorner of a 0.422 acre tract conveyed to J. Colley and B. Mince as described in a deed recorded in Volume 622, Page 456 of the Deed Records of Williamson County, Texas for a corner and the TRUE POINT OF BEGINNING of this herein described tract; THENCE along the South and Southwest lines hereof the following three (3) calls: 1.) 543 01' 30 "W, 180.51 feet to an iron pin set; 2.) N63 °W, 215.20 feet to an iron pin set; 3.) N37° 23'W, 504.28 feet to an iron pin set for the Western most corner hereof; THENCE N 52° 37'E, 169.00 feet to an iron pin set; THENCE N 11° 10'W, 134.52 feet to an iron pin set; THENCE N 18° 59' W, 175.25 feet to an iron pin set; THENCE N 84° 00' 45 "E, 61.12 feet to an iron pin set; THENCE N 04° 02' 40 "W, 176.36 feet to an iron pin set; THENCE N 85° 57' 20 "E, 141.27 feet to an iron pin set for a Point of Curvature; THENCE along the arc of a curve to the left having elements of delta 14 01' 24 ", rad.= 230.00 feet, tan. =28.29 feet, arc =56.29 feet, chord and chord bearing of 56.15 feet and N 78° 56' 38 "E to an iron pin set to a Point of Compound Curvature; THENCE along the arc of a curve to the left having elements of delta= 93° 46' 56 ", rad. =25.00 feet, tan. =26.71 feet, arc =40.92 feet, chord and chord bearing of 36.50 feet and N25 °02'28 "E to an iron pin set; THENCE S 21° 51'E, 105.40 feet pass an iron pin found in the West line of said Onion Creek Village Section One, 171.38 feet in all to an iron pin found in said West line of Onion Creek Village Section One; THENCE along and with the West line of said Onion Creek Village, Section One for a common line hereof, the following six (6) calls: 1.) S21° 54' 30 "E, 429.93 feet to an iron pin found for a Point of Curvature; 2.) Along the arc of a curve to the right having elements of delta= 65 ° 16', rad. =65.00 feet, tan. =41.62 feet, arc =74.04 feet, chord and chord bearing of 70.10 feet and S 10° 43' 30 "W to an iron pin found for a Point of Tangency; 3.) S 43° 21' 30 "W, 118.48 feet to an iron pin found for a Point of Curvature; 4.) Along the arc of a curve to the right having elements of delta =23° 15' 40 ", rad.= 100.00 feet, tan. =20.58 feet, arc =40.60 feet, chord and chord bearing of 40.32 feet and S 54° 58' 20 "W to an iron pin found for a Non - Tangent Point; 5.) S23° 22' 50 "E, 60.00 feet to an iron pin found; 6.) S36° 01' 15 "E, 125.15 feet to an iron pin found at the Northwest corner of said 0.422 acre tract; THENCE along the West line of said 0.422 acre tract, a common line hereof, S46° 22'E, 160.02 feet to the TRUE POINT OF BEGINNING and containing 8.268 acres of land more or less; and WHEREAS, the City Council has submitted the proposed change in the Zoning Ordinance to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the changing of said Zoning Ordinance on the above - described property from "B -2" Local Business District to "R -2" Multi- Family Residential District, -2- after holding a public hearing thereon on the 1st day of December, 1977, and the City Planning and Zoning Commission has approved and recommended to the City Council on the 1st day of December, 1977, that the Zoning Ordinance and Zoning Ordinance Map be amended so that the above - described property be changed from "B -2" Local Business District to "R -2" Multi- Family Residential District; and WHEREAS, each and every requirement set forth in the Zoning Ordinance concerning notices, hearings, and other procedural matters have been fully complied with; NOW, THEREFORE, be it ordained by the Council of the City of Round Rock, Texas, that the Zoning Ordinance and the Zoning Ordinance Map of the City of Round Rock, Texas, be amended so that the property above - described shall be and the same is hereby removed from "B -2" Local Business District to "R -2" Multi- Family Residential District. (Mark through the following alternative that is not applicable.) Alternative 1.
