AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND
ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, AMENDING THE
ZONING ORDINANCE MAP AND MAKING THIS AMENDMENT A PART
OF THE MAP OF THE ORIGINAL ORDINANCE: TO ESTABLISH
ZONING DISTRICTS IN THE TERRITORY KNOWN AS THE OLD
TOWN ANNEXATION (360 ACRES) BY ADOPTING A ZONING
ORDINANCE TANCE MAP SUPPLEMENT PREPARED IN ACCORDANCE WITH A
PLAN RECOMMENDED BY THE CITY PLANNING AND ZONING COMMISSION
FOR PERMANENT ZONING IN THE AREA, AS HEREINAFTER SET FORTH,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
WHEREAS, a plan has been submitted to the City Council of the
City of Round Rock, Texas, for the purpose of amending the Zoning
Ordinance and amending the Zoning Ordinance Map by adopting a Zoning
Ordinance Map Supplement (Exhibit A) to establish zoning districts
in the territory known as the Old Town Annexation (360 Acres); and
WHEREAS, the City Planning and Zoning Commission has approved
the changing of said Zoning Ordinance and Zoning Ordinance Map through
the adoption of a Zoning Ordinance Map Supplement establishing zoning
districts in the territory known as the Old Town Annexation, after
holding a public hearing thereon on the 2nd day of March, 1978, and
the City Planning and Zoning Commission has recommended to the City
Council on the 2nd day of March, 1978, that the Zoning Ordinance and
the Zoning Ordinance Map be amended according to said plan for the
purpose of establishing zoning districts in the territory known as
the Old Town Annexation; and
WHEREAS, each and every requirement set forth in the Zoning
Ordinance concerning notices, hearings, and other procedural matter
has been fully complied with;
NOW THEREFORE, be it resolved by the City Council of the City
of Round Rock, Texas, that the Zoning Ordinance and the Official
Zoning Map of the City of Round Rock, Texas, be amended so that the
territory known as the Old Town Annexation shall be and the same is
hereby removed from Temporary "R -1" Single - Family Residential
District to permanent zoning districts. The locations and boundaries
of the districts herein established are shown upon the Zoning Ordinance
Map Supplement, which is hereby incorporated into this Ordinance.
Said Zoning Ordinance Map Supplement, together with all notations,
references, and other information shown thereon shall be as much a
part of this Ordinance as if fully set forth and described herein.

4B. Consider a request by Don Quick to modify the official zoning map by extending
the boundaries of the "B -2" Local Business District to include a 1.221 :acre tract of land
in the Old Town Area. Gambrel explained that it was through city staff initiative that
this subject was brought before the Board. Due to an oversight at the time of the annexa-
tion of the Old Town Area, the tract was zoned "R -1 ". It was staff's intention to give
"B-2" designation to all tracts of land which had "B -2" uses on them at the time of annexa-
tion. It is now the recommendation of staff that "B -2" designation be extended to include
Quick's site.
MOTION: Autrey moved to extend the "B -2" district to include Dan Quick's tract in
the Old Town Area designated as, That certain 1.221 acre tract of land which is owned by
Don Quick and which is located in the Old Town Area west of and adjacent to the IH 35
facility and adjacent to and north and east of Round Rock Center West Section 1." Canon
seconded the motion.
ACTION: The motion carried unanimously.
4C. Consider a request for a special permit for Regal Sign Company for the authoriza-
tion of the Kentucky Fried Chicken sign. Ren6 Drouin, present as a representative for the
Regal Sign Co., deferred to staff for an explanation of the special permit request.
Seminara explained that a staff error in incorrectly establishing the boundary of the
subject tract resulted in an insufficient sign set back. Drouin answered several board
members' questions regarding specifics concerning the sign location. Gambrel explained
the policy concerning a curbed base for signs.
MOTION: Autrey moved to authorize the issuance of a special permit for the location of
the Kentucky Fried Chicken sign. McConico seconded the motion.
ACTION: The motion carried unanimously.
5. OLD BUSINESS:
Gambrel asked for clarification on the Board's desire for notification with regard
to special permits. The consensus was that notification at city hall is sufficient.
Metzler intends to personally contact those parties possibly affected by special permit
requests while he is in the neighborhood examining the situation.
6. NEW BUSINESS: There was no new business.
7. STAFF REPORT AND BOARD MEMBER COMMENTS:
Staff pointed out the inclusion in the board members' packets of copies of the ordi-
nance adopting the General Plan which rearranges several sections of the City Code of
Ordinances. The board members expressed a desire for all members and alternates to receive
complete packets for all meetings in order to remain informed on actions by the Board.
The motion to adjourn was made by Autrey, seconded by McConico and carried unanimously.
The meeting was adjourned at 7:30 P.M.

6A. Discuss public notice procedure.
There was discussion of whether it is necessary for the Board to give Public
Notice. The concensus was that since no provision is made for the Board to do more than
post an agenda, this procedure would be sufficient. Notification of the people who wish
to appear before the Board is necessary and the city staff will see to that.
7. Staff Report and Board Member Comments
Board members were invited to the up- coming council meeting, July 26, 1979, to
receive their certificates of appointment.
8. Adjournment
Autrey moved that the meeting be adjourned and May seconded the motion. Ad-
journment at 9:25.

Building Inspection and Code Enforcement
The Board of Adjustment met at a special called meeting on September 25, 1979, with
the following members present: Chairman Ted Metzler, Vice Chairman Clint Autrey, Garfield
McConico, Hillery Canon and Joe Baker. Also present were Planning Director Paul Gambrel
and Building Inspection staff member Melissa Seminara. The meeting was called to order
at 7:00 P.M.
3. APPROVAL OF MINUTES: Metzler noted several corrections to the minutes of the
July 17, 1979 meeting (corrections inserted into original minutes on pages 4, 5, & 7).
The motion was made by McConico and seconded by Autrey to approve the minutes as corrected.
The motion carried unanimously.
4. REQUESTS FOR HEARING BEFORE BOARD:
A. Consider a request for a special permit for construction in the Rubio Subdivision
by Ruben Perez. Perez explained the nature of his request for a special permit to con-
struct an addition to his house at 801 Tony Drive located in the Rubio Subdivision. The
subject addition would require a modification of the "R -1" yard requirements as specified
in the Zoning Ordinance. As this modification may be authorized by a special permit,
city staff recommended the issuance of the permit. In response to questions from board
members, Perez explained that he had received a variance from rear yard requirements in
1977 from the Planning and Zoning Commission for an addition to his dwelling. This time
his front yard would be affected by the addition. There was no testimony in objection
to his request.
MOTION: Canon moved to grant Ruben Perez a special permit to build an addition
30' X 35' on to his house which will be 26' from the rear lot line at the northeast
corner, 8' to 10' from the rear lot line at the southeast corner, 15' from the side lot
line on the north side of the addition, and approximately 8' from the front lot line on
the west side of the addition as per his site plan submitted to the Building Inspection
Department. Autrey seconded the motion.
ACTION: The motion carried unanimously.
