O-78-480 - 7/27/1978ORDINANCE NO. 442 AN ORDINANCE ADDING TO THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, ADDING TO THE ZONING ORDINANCE MAP AND MAKING THIS ADDITION A PART OF THE MAP OF THE ORIGINAL ZONING ORDINANCE BY ADDING CERTAIN NEWLY ANNEXED PROPERTY TO WIT: THE T. L. WRIGHT TRACT ANNEXATION BEING 0.62 ACRES OF LAND OUT OF THE WILEY HARRIS SURVEY IN ROUND ROCK, TEXAS, AS DESCRIBED BE- LOW: REMOVING SAID PROPERTY FROM TEMPORARY "R -1" SINGLE - FAMILY RESIDENTIAL DISTRICT TO PERMANENT "B -2" LOCAL BUSINESS DISTRICT, AS HEREINAFTER SET FORTH. WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of providing permanent zoning of "B -2" Local Business District in place of temporary "R -1" Single - family Residential District on the following described real property, to wit: BEING a 0.620 acre tract of land out of the Wiley Harris Survey, Abstract No. 298 and situated in Williamson County, Texas, said 0.620 acre tract being the northeastern most portion of a 22 acre tract of land conveyed to Elmer Hester and referred to as "First Tract" in a deed recorded in Volume 236, Page 523 of the Deed Records of Williamson County, Texas, said 0.620 acre tract being more particularly described by metes and bounds as follows: BEGINNING at an iron pin found in the north right -of -way line of U.S. Highway 79, same being the southwest corner of a 4.585 acre tract of land conveyed to Tom E. Nelson, Jr., Trustee by Billie Sue M. Henna as described in a deed recorded in Volume 539, Page 129 of the Deed Records of Williamson County, Texas, same being a point in the east line of said 22 acre tract for the southeast corner hereof; THENCE along the north right -of -way line of said U.S. Highway 79, the south line hereof, South 78° 15' West, 125.42 feet to an iron pin set at a Highway concrete monument for the southwest corner hereof; THENCE along the east right -of -way line of U.S. Highway 35 where it intersects the north right -of -way line of said U.S. Highway 79, the west line hereof, North 56° 42' West, 183.09 feet to an iron pipe found at the southwest corner of a 1.948 acre tract of land conveyed to Tom E. Nelson, Jr., Trustee by Billie Sue Henna as described in a deed recorded in Volume 574, Page 691 of the Deed Records of said county, for the northwest corner hereof; THENCE, departing the east right -of -way line of said U.S. Highway 35 easterly along the south line of said 1.948 acre tract, the north line hereof, North 70° 57' 30" East, 235.04 feet to an iron pin found in the west line of said 4.585 acre taract, same being the southeast corner of said 1.948 acre tract, for the northeast corner hereof; THENCE along the west line of said 4.585 acre tract, the east line hereof, South 19° 28' 45" East, 160.87 feet to the PLACE OF BEGINNING and containing 0.620 acres of land more or less. WHEREAS, the City Council has submitted the proposed designation of perma- nent zoning to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the designa- tion of permanent zoning for the above - described property of "B -2" Local Business District, after holding a public hearing thereon on the 20th day of July, 1978, and the City Planning and Zoning Commission has approved and recommended to the City Council on the 20th day of July, 1978, that the above - described property be given a permanent zoning designation of "B -2" Local Business District; and WHEREAS, each and every requirement set forth in the statutes of the State of Texas and in the Zoning Ordinance of the City of Round Rock, concerning notices, hearings, and other procedural matters has been fully complied with; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT An addition be made to the Zoning Ordinance and zoning map of the City of Round Rock, Texas, so that the above - described property shall be and the same is hereby removed from Temporary "R -1" Single - family Residential District to "B -2" Local Business District. (Mark through the following alternative that is not applicable.) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two sepa- rate days was dispensed with.
