O-78-481 - 7/27/1978ORDINANCE NO. 2 41 ' O AN ORDINANCE ADDING TO THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, ADDING TO THE ZONING ORDINANCE MAP AND MAKING THIS ADDITION A PART OF THE MAP OF THE ORIGINAL ZONING ORDINANCE BY ADDING CERTAIN NEWLY ANNEXED PROPERTY TO WIT: THE TOM E. NELSON TRACT ANNEXATION BEING 1.944 ACRES OF LAND OUT OF THE WILEY HARRIS SURVEY IN ROUND ROCK, TEXAS, AS DESCRIBED BE- LOW: REMOVING SAID PROPERTY FROM TEMPORARY "R -1" SINGLE - FAMILY RESIDENTIAL DISTRICT TO PERMANENT "B -2" LOCAL BUSINESS DISTRICT, AS HEREINAFTER SET FORTH. WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of providing permanent zoning of "B -2" Local Business District in place of temporary "R -1" Single- family Residential District on the following described real property, to wit: FIELD NOTES describing a 1.944 acre tract or parcel of land out of the Wiley Harris Survey, Abstract No. 288, situated in Williamson County, Texas, being all of that same tract conveyed to Tom E. Nelson, Trustee, described in a Deed of Trust recorded in Volume 164, Page 541 of the Deed Records of said County; BEGINNING at an iron pipe found at the northwest corner of said Nelson tract being in the east R.O.W. line of Interstate Highway No. 35; THENCE North 70° 43' 30" East, 263.69 feet to an iron pipe found at the northeast corner of said Nelson tract; THENCE South 19° 00' East, 40.26 feet to an iron pin found and South 19° 45' 50" East, 267.72 feet to an iron pipe found at the southeast corner of said Nelson Tract, being in the north R.O.W. line of U.S. Highway No. 79; THENCE South 70° 57' 30" West, 235.04 feet along said R.O.W. line to an iron pipe found at the southwest corner of said Nelson Tract; THENCE North 56° 42' West, 100.28 the remains of a concrete highway of Interstate Highway No. 35; THENCE North 11° 42' West, 229.15 to the POINT OF BEGINNING of this 1.944 acres of land more or less. feet to an iron pin set by monument in said east R.O.W. feet along said east R.O.W. described tract containing WHEREAS, the City Council has submitted the proposed designation of per- manentzoningto the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the desig- nation of permanent zoning for the above - described property of "B -2" Local Business District, after holding a public hearing thereon on the 20th day of July, 1978, and the City Planning and Zoning Commission has approved and recommended to the City Council on the 20th day of July, 1978, that the above- described property be given a permanent zoning designation of "B -2" Local Business District; and WHEREAS, each and every requirement set forth in the statutes of the State of Texas and in the Zoning Ordinance of the City of Round Rock, concerning notices, hearings, and other procedural matters has been fully complied with; NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: An addition be made to the Zoning Ordinance and zoning map of the City of Round Rock, Texas, so that the above- described property shall be and the same is hereby removed from Temporary "R -1" Single- family Residential District to "B -2" Local Business District. (Mark throught the following alternative that is not applicable.) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two sepa- rate days was dispensed with.
