O-78-490 - 10/26/1978ORDINANCE NO.. 4 /90 AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, AMENDING THE ZONING ORDINANCE MAP AND MAKING THIS AMENDMENT A PART OF THE MAP OF THE ORIGINAL ORDINANCE: TO CHANGE 9.77 ACRES, MORE OR LESS, OUT OF THE JACOB M. HARRELL SURVEY, WILLIAMSON COUNTY, TEXAS, AS DESCRIBED BELOW FROM "R -1" SINGLE - FAMILY RESIDENTIAL TO "R -2" MULTI - FAMILY RESIDENTIAL DISTRICT , AS HEREINAFTER SET FORTH. WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of amending the Zoning Ordinance from "R -1" Single -famil Residen ial D to "R -2" Multi- family Residential District on the property, described in Exhibit "A" attached hereto and made a part hereof, and WHEREAS, the City-Council has submitted the proposed change in the Zoning Ordinance to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the changing of said Zoning Ordinance on the above - described property from "R -1" Single - family Residential District to "R -2" Multi - family Residential District , after holding a public hearing thereon. on the 19th day of October 19 7 that the Zoning Ordinance be amended so that the above- described property be changed from "R -1" Single- family Residential District to "R -2" Multi- family Residential District ; and WHEREAS, each and every requirement set forth in the Zoning Ordinance concerning notices, hearings, and other procedural matters have been fully complied with, now therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the Zoning Ordinance and the zoning map of the City of Round Rock, Texas, be amended so that the property described in Exhibit "A" attached hereto and made a part hereof shall be and the same is hereby removed from "R -1" Single- family Residential District to "R -2" Multi- family Residential District (Mark through the following alternative that is not applicable.) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. Harrell Survey, Abstract No. 284, and being more fully described as follows: BEGINNING at an iron pin set by a fence corner for the Northeast corner of a Bernard G. Barber, 13 7/8 acre First Tract as described in Volume 387, Page 169 of the Williamson County Deed Records, said corner also being the Northeast corner of the Jacob M. Harrell Survey, Abstract No. 284, and the Northwest corner of the Wiley Harris Survey, Abstract No. 298; THENCE along the East line of said 13 7/8 acre Barber Trace, the East line hereof; 1) S19 °24'E, 398.06 feet to an iron pin set in said East line at the Northwest corner of a tract described as First Tract in said Barber Deed; THENCE around the remainder of said First Tract the following five (5) courses: 1) N85 °08'30 "E, 175.54 feet, 2) S17 °58 "E, 128.50 feet, 3) N68 °53'E, 33.50 feet, 4) S10 °45'50 "E, 94.00 feet, 5) N82 °45'30 "W, 198.97 feet to a point in the aforesaid East line of said Barber Fourth Tract; THENCE along said East line the following three (2.) courses: 1) S17 °24'10 "E, 280.42 feet to an iron pin set; 2) S17 °20'20 "E, 10.40 feet to an iron pin set, being the Southeast corner hereof; THENCE S71 °11'50 "W, 451.37 feet to an iron pin set in the West line of said Barber Tract also being the East right -of -way line of Chisholm Trail Road, County Road No. 173; being the Southwest corner hereof; THENCE along the West line of the said Barber Tract, the following Two (2) courses: 1) N18 °48'10 "W, 300.95 feet to an iron pin set; 2) N19 °01'20 "W, 572.27 feet to an iron pin set, being the Northwest corner of said Barber Tract being Northwest corner hereof; THENCE along North line of said 13 7/8 Barber Tract, also the North' line of the Jacob M.
