O-78-492 - 11/21/1978ORDINANCE NO. 4 AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, AMENDING THE ZONING ORDINANCE MAP AND MAKING THIS AMENDMENT A PART OF THE MAP OF THE ORIGINAL ORDINANCE: TO CHANGE 6.773 ACRES, MORE OR LESS, OUT OF THE J. M. HARRELL SURVEY, WILLIAMSON COUNTY, TEXAS, AS DESCRIBED BELOW FROM "R -1" SINGLE - FAMILY RESIDENTIAL DISTRICT TO "B -1" GENERAL BUSINESS DISTRICT , AS HEREINAFTER SET FORTH. WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of amending the Zoning Ordinance from "R -1" Single - family Residential District to "B -1" General Business District on the property, described in Exhibit "A" attached hereto and made a part hereof, and WHEREAS, the City.Council has submitted the proposed change in the Zoning Ordinance to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the changing of said Zoning Ordinance on the above - described property from "R -1" Single - family Residential District to "B -1" General Business District , after holding a public hearing thereon on the 16th day of November 1978 , that the Zoning Ordinance be amended so that the above - described property be changed from "R -1" Single- family Residential District to "B -1" General Business District ; and WHEREAS, each and every requirement set forth in the Zoning Ordinance concerning notices, hearings, and other procedural matters have been fully complied with, now therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the Zoning Ordinance and the zoning map of the City of Round Rock, Texas, be amended so that the property described in Exhibit "A" attached hereto and made a part hereof shall be and the same is hereby removed from "R -1" Single- family Residential District to "B -1" General Business District (Mark through the following alternative that is not applicable.) By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. Mayor City of Round Roc , Texas EXHIBIT "A" BEING 6.773 acres of land, more or less, being more particularly described by metes and bounds as follows: BEGINNING AT A POINT for the northwest corner hereof: Said point also being the northeast corner of a tract of land conveyed to Michael E. Bennett and Larry D. PresTar as recorded in Volume 584, Page 661; Volume 602, Page 753 and Volume 638, Page 68 of the Deed Records of Williamson County, Texas; THENCE South 8° 10' West, 205 feet to a point on the proposed new north right -of- way line of RM Highway 620, said point also being 60 feet left of and normal to RM Highway 620 relocated centerline station 489 + 29.01; THENCE along said proposed right -of -way line around a curve to the right with a radius of 3879.72 feet, and an arc distance of 211.95 feet to a point of tangency; THENCE along said proposed right -of -way line South 79° 40' East, 270 feet, more or less, to an old fence; THENCE continuing along said proposed right -of -way line South 79° 40' East, 289.24 feet, more or less, to a point; THENCE continuing along said proposed right -of -way line around a curve to the right with a radius of 580.87 feet, and an arc distance of 80.68 feet to a point on the west right -of -way fence line of the Georgetown Railroad for the southeast corner hereof; THENCE along said west railroad right -of -way fence line North 19° West, at 548.42 feet rest, a steel stake placed on the west bank of Brushy Creek, and at 579.21 feet in all, a point in the center of said stream for the northeast corner hereof; THENCE up the center of said stream in a straight line which bears North 87° 39' 27" West, 163.07 feet to a point for the norhernmost corner hereof; THENCE continuing with the center of Brushy Creek South 66° 19' 30" West, 513.2 feet to a point for the northwest corner hereof and the POINT OF BEGINNING, and containing 6.773 acres of land, more or less.
