O-79-606 - 4/12/1979ORDINANCE NO. _ __ AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, AMENDING THE ZONING ORDINANCE MAP AND MAKING THIS AMENDMENT A PART OF THE MAP OF THE ORIGINAL ORDINANCE. TO CHANGE 19.3 ACRES, MORE OR LESS, OUT OF THE WILEY HARRIS SUR- VEY, WILLIAMSON COUNTY, TEXAS, AS DESCRIBED BELOW FROM "R-l" SINGLE FAMILY RESIDENTIAL DISTRICT TO "R--2" MULTI- FAMILY RESIDENTIAL DISTRICT, AS HEREINAFTER SET FORTH. WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of amending the Zoning Ordinance from "R,1" Single Family Residential District to "R'2" Multi Residential District on the property, de- scrihed in Exhibit "A" attached hereto and made a part hereof, and WHEREAS, the City Council has submitted the proposed change in the Zoning Ordinance to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has condition- ally approved the changing of said Zoning Ordinance on the above - described property from "R -1" Single Family Residential District to "R-2" Multi Family Residential District, after holding a public hearing thereon on the 15th day of February, 1979, that the Zoning Ordinance be amended so that the above - described property be changed from "R-1" Single Family Residential District to "R -2" Multi - Family Residential District conditioned upon final plat approval, and WHEREAS, each and every requirement set forth in the Zoning Ordinance concerning notices, hearing, and other procedural matters have been fully complied with, now therefore BE IT ORDAINED BY THE COUNCIL 'OF THE CITY OF ROUND ROCK, TEXAS: That the Zoning Ordinance and the zoning map of the City of Round Rock, Texas, be amended so that the property described in Exhibit "A" attached hereto and made a part hereof shall be and the same is hereby removed from "R -1" Single Family Residential District to "R-2" Multi - Family Residential District. However, the 'zoning change 'provided herein shall not become effective in any manner until and after the Planning and Zoning Commission has approved a final plat therefore, The property may be zoned and platted in sections as approved by the Planning and Zoning Commission. (Mark through the following alternative that is not applicable) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. LOCATION: North of and abutting Gattis School Road, south of and abutting Greenslopes (Section 2) at Lake Creek, west of and abutting Greenslopes (Section 4) at Lake Creek. For existing zoning based on a population range of 197 -231: 1) Traffic: 1852 -2171 vehicle trips per day. 2) Water: 29,550 - 34,650 gallons per day (average). 3) Sewer: 19,799 - 23,216 gallons per day. ANALYSIS: The instant request is to rezone as a first step in the development of a substantial apartment complex. From a land use perspective, the subject tract is well suited to multi - family development. It fronts on Gattis School Road which is in the process of being upgraded to a major thoroughfare and the improvements to it, recently authorized, should take place by September 1980. Additionally, the subject tract abuts the Greenslopes at Lake Creek shopping area (B -1), and has been itself identified for higher than single family development. Specific- ally this tract has been placed in the IA -2 category which would allow as many as 14 dwelling units per acre. Presently the applicant is requesting, in effect, that this tract be upgraded to the IA -3 level and made an extension of the IA -3 area immediately to the east so that the applicant may proceed to develop at a rate of 20 dwelling units per acre -- an increase of 114 dwelling units. Rezoning to "R -2" would provide that authorization. In terms of timing, the applicant anticipates that the apartment complex would be developed at a rate of approximately 100 units per year. In reviewing the instant zoning request, the Planning Staff is satisfied that the proposed land use is reasonable and equates roughly with planning expectations, and that the rezoning being sought is basicly supportable. However, the Planning Staff also is of the opinion that Zoning, as such, simply does not provide the safeguards which will be necessary to insure that the interests of the City are adequately served in conjunction with the proposed development. Rezoning without subdivision platting does not guarantee that the following significant concerns are addressed: VI & VII - PUBLIC HEARING AND ZONING RECOMMENDATION (continued) Page 2 1) dedication of additional R.O.W. along Gattis School Road; 2) inclusion within the development of a public street with 40 feet of paving to bear the traffic and extend public utilities in a public R.0,14.; 3) issuance of certifi- cates of serviceability to insure adequacy of water and sewer service; 4) pro- vision of street lighting, fire plugs, drainage improvements, etc., as specified by subdivision regulations; and 5) parkland dedication according to subdivision requirements; and 6) city coordinated sequential development of the tract, generally. RECOMMENDATION: The adoption of an amendatory zoning ordinance stipulating that the requested "R -2" rezoning be granted for each section of the proposed development as the respective section is granted approval by the Planning and Zoning Commission as a final plat.
