O-79-614 - 5/24/1979ORDINANCE NO. 6/4 AN ORDINANCE ADDING TO THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, ON THE 2ND DAY OF OCTOBER, 1969, ADDING TO THE ZONING ORDINANCE MAP AND MAKING THIS ADDITION A PART OF THE MAP OF THE ORIGINAL ZONING ORDINANCE BY ADDING CERTAIN NEWLY ANNEXED PROPERTY TO -WIT: WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of providing permanent zoning of newly annexed property described in Exhibit "A ", attached hereto and made a part hereof; and WHEREAS, the City Council has submitted the proposed designation of permanent zoning to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission has approved the designation of permanent zoning for the above- described property of "B -2" Local Business District , after holding a public hearing therein on the 17th day of May 19 79, that the above - described property be given a permanent zoning designation of "B -2" Local Business District ; and WHEREAS, each and every requirement set forth in the statutes of the State of Texas and in the Zoning Ordinance of the City of Round Rock, concerning notices, hearings, and other procedural matters has been fully complied with; NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: An addition be made to the Zoning Ordinance and zoning map of the City of Round Rock, Texas, so that the property described in Exhibit "A ", attached hereto and made a part hereof, shall be and the same is permanently zoned "B -2" Local Business District (Mark through the following alternative that is not applicable.) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. L. Egger by Deed recorded in Volume 259, Page 259 of the Deed Records of Williamson County, Texas; said 30.00 acres being more particularly described by metes and bounds as follows: Beginning at an iron pin found in the South line of said Wiley Harris Survey Abstract No. 298, being the North line of the Asa Thomas Survey Abstract No. 609; said iron pin being in the West right -of -way line of U.S. Highway No. 81 and in the South line of an abandoned portion of County Road No. 168 (Gattis School Road); said iron pin also being the Northeast corner of a 7.151 acre tract conveyed to N. G. Whitlow, Trustee, by deed recorded in Volume 676, Page 329 of said Deed Records, and also being the Southeast corner and Point of Beginning of the hereinafter described 30.00 acre tract; THENCE along the division line between said Harris and Thomas Surveys, being the North line of said Whitlow tract, and the South line hereof, S70 ° 42'35 "W, 500.61 feet to an iron pin found in the East right -of -way line of Interstate Highway No. 35, being Whitlow's Northwest corner and the Southwest corner hereof; TFIENCE along said East right -of -way line, the West line hereof, the following two (2) courses: 1) along the arc of a curve to the North having elements of delta = 8 °28'24 ", radius = 11,634.20 feet, tangent = 861.84 feet, arc = 1,720.53 feet, chord and chord bearing= 1,718.96 feet, N21 °00'15 "W, to a concrete highway monument found at an angle point of said East right -of -way line for an angle point hereof; 2) N12 °39'W, 110.33 feet to a point in said East right -of- way line for the Northwest corner hereof; THENCE along the North line hereof, the following three (3) courses: 1) N77 °21'E, 772.04 to a point for an ell corner hereof; 2) S06 ° 47'50 "E, 148.74 feet to an iron pin set for an ell corner hereof; 3) N88 °42'E, 262.28 feet to an iron pin set in the West right -of -way line of U.S. Highway No. 81, for the most Easterly Northeast corner hereof; THENCE along the West right -of -way line of U.S. Highway No. 81, S02 °53'50 "E, 1576.36 feet to the Point of Beginning of the herein described tract of land, containing 30.00 acres of land more or less.
