O-79-634 - 12/27/1979ORDINANCE NO. 4;34 AN ORDINANCE ADDING TO THE OFFICIAL ZONING MAP PASSED AND ADOPTED IN CHAPTER 11, SECTION 2.E.(2) OF THE CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS, ADDING TO THE OFFICIAL ZONING MAP AND MAKING THIS ADDITION A PART OF THE OFFICIAL MAP BY ADDING CERTAIN NEWLY ANNEXED PROPERTY TO -WIT: WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas, for the purpose of providing permanent zoning of newly annexed property described in Exhibit "A ", attached hereto and made a part hereof; and WHEREAS, the City Council has submitted the proposed designation of permanent zoning to the City Planning and Zoning Commission for its recommendation and report; and WHEREAS, the City Planning and Zoning Commission on the 20th day of December , 1979 , held a public hearing to consider the designation of permanent zoning for the above - described property, and has approved and recommended to the City Council on the 20th day of December , 1979 , that the Official Zoning Map be amended so that the above- described property be given a permanent zoning designation of I -1 Light Industrial District ; and WHEREAS, each and every requirement set forth in the statutes of the State of Texas and in the Code of Ordinances of the City of Round Rock, concerning notices, hearings, and other procedural matters have been fully complied with; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: An addition be made to the Official Zoning Map of the City of Round Rock, Texas, so that the property described.in Exhibit "A ", attached hereto and made a part hereof, shall be and the same is permanently zoned I -1 Light Industrial District (Mark through the following alternative that is not applicable.) Holder Survey, Abst. #297 in Williamson County, Texas, part of a 46.838 acre tract described in a Deed to Steve Foley in Vol. 602, Page 174, Deed Records of Williamson County, Texas. PORTION OF HIGHWAY 79 CORRIDOR (PHASE II) ANNEXATION ZONING December 20, 1979 Page 2 ANALYSIS: The subject tract which contains the Classic Car Center is a portion of an annexation which occurred much earlier this year. Recently the property owners communicated their desire to be granted permanent zoning. FACTUAL CONSIDERATIONS AND PROPOSED FINDINGS: Accordance with the General Plan. By location and existing use this tract warrants some level of commercial zoning. The neighboring land use immediately to the west, also a part of this annexation, is clearly an "I -1" use. It is on this basis combined with the close proximity to rail on the south side of Highway 79 that the staff proposes "I -1 ". Staff Proposal: To recommend I -1 Light Industrial District zoning for the subject tract. PLANNING AND ZONING COMMISSION RECOMMENDATION TO THE CITY COUNCIL: MOTION: Heiligenstein moved to recommend to the City Council that the portion of the Highway 79 Corridor (Phase II) Annexation be zoned I -1 Light Industrial District. Hislop seconded the motion. VOTE: The following members voted YES: Tibbitts, Baca, Carter, Haner, Heiligenstein, Hislop, and Howell. Perez voted NO. The motion carried 7 -1.
