CM-2022-233 - 10/7/2022STATE OF TEXAS § COUNTY OF WILLIAMSON § SUPPLEMENTAL CONTRACT NO. 5 TO CONTRACT FOR ENGINEERING SERVICES FIRM: CP&Y, INC._ ("Engineer") ADDRESS: 13809 Research Boulevard Suite 300 Austin TX 78750 PROJECT: Northeast Downtown Improvements This Supplemental Contract No. 5 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and CP&Y, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract," on the 12th day of September, 2019 for the Northeast Downtown Improvements Project in the amount of $960,600.54; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on April 24, 2020 to amend the scope of services and to increase the compensation by $22,482.00 to a total of $983,082.54; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on November 12, 2020 to amend the scope of services and to increase the compensation by $137,950.00 to a total of$1,121,032.54; and WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on July 9, 2021 to amend the scope of services and to increase the compensation by $19,500.00 to a total of $1,139,532.54; and WHEREAS, the City and Engineer executed Supplemental Contract No. 4 on January 27, 2022 to amend the scope of services and to increase the compensation by $93,050.00 to a total of $1,232,582.54; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $48,170.00 to a total of $1,280,752.54; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: upplemcntal Contract 0199.1949, 4859 4662 0980 Rev.06116 84275 1. Article 2 Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. it. Article 4 Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $48,170.00 the maximum amount payable under the Contract for a total of $1,280,752.54, as shown by the attached Addendum to Exhibit D. Sand —re, City Attorney � 7 wi 1r--1- ;Z,�7 Date Supplemental Contract Rcv.06;' [ 6 0199.1949; 4859-4662-0980 84V.5 ADDENDUM TO EXHIBIT B Engineering Services In addition to the scope outlined in the Northeast Downtown Revitalization Project contract, dated September 12, 2019; Supplemental No. I; Supplemental No. 2; Supplemental No. 3, and Supplemental No. 4; the engineer shall provide two alternative parking designs and schedule extension related to the development at Austin Ave and Lampasas St and ongoing Library project coordination. Following a decision on the parking layout, the roadway sheets will be updated accordingly. The schedule has been extended to accommodate change requests and regular adjustments to construction sequencing associated with the Library construction. Additional project management is included for the aforementioned work. The tasks and products are more fully described in the following TASK OUTLINE. TASK OUTLINE Ill. ADDITIONAL SERVICES F. Additional effort for Supplemental No. S: I. PARKING DESIGN (a) Coordinate with contractor and surveyor to obtain the necessary information to design the parking. (b) Coordinate with City and developer's engineer on design elements via calls, meetings, and site visits. (c) Prepare two alternatives of parking design and one final version following decision on parking style. Update roadway sheets accordingly. 2. The City has a project underway to improve the infrastructure in the Northeast Downtown area of Round Rock. The proposed utility and roadway improvements associated with this project will revitalize this area, support the new library site, and support future development. Supplemental Agreement No. S is for design of additional parking along Austin Street and additional construction phase services. This supplemental increases the compensation by $48,170, and brings the total contract amount to $1,280,752.54.
