AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, ADOPTED IN CHAPTER 11, SECTION 3.E.(2), CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO -WIT: TO CHANGE 1.154 ACRES, MORE OR LESS, OUT OF THE JACOB M. HARRELL SURVEY, WILLIAMSON COUNTY, TEXAS, AS DESCRIBED BELOW FROM DISTRICT R - (LOW DENSITY RESIDENTIAL TO DISTIRCT C - 1 (COMMERCIAL) ORDINANCE NO. /n/ WHEREAS, an application has been made to the City Coun- cil of the City of Round Rock, Texas to amend the Official Zoning Map to change the zoning classification of the proper- ty described in Exhibit "A" from District R - (Low Density Residential) to District C -1 (Commercial) WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 20th day of___ October , 19 83 , following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the zoning classification of the above described property be changed from to District C -1 (Commercial) District R -1 (Low Density Residential) , and WHEREAS, on the 27th day of October 1983 , after proper notification, the City Council held a public hearing on the requested change, and WHEREAS, the City Council has determined that sub- stantial changes in conditions have occurred which justify the zoning classification change provided for herein, and WHEREAS, the City Council determines that the zoning classification change provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Art. 1011a -f V.A.T.S. and Chapter 11, Section 3, Code of Ordi- nances, City of Round Rock, Texas concerning public notices, hearings, and other procedural matters has been fully complied with, NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK., TEXAS I . That the Official Zoning Map adopted in Chapter 11, Section 3.E.(2), Code of Ordinances, City of Round Rock, Texas is hereby amended so that the zoning classification of the property described in Exhibit "A" attached hereto and incorporated herein is hereby changed from District R -1 (Low Density Residential) and shall be, and hereafter designated as District C -1 (Commercial) (Mark through the following alternative that is not appli- cable) Alternative 1. Harrell Survey, Abstract No. 284 situated in the Town of Round Rock, Williamson County, Texas, being all of the remainder of those tracts of land described in Volume 110, Page 35 and Volume 117, Page 412, a one acre tract and a 0.5 acre tract respectively and all of that 0.077 acre tract described in Volume 818 , Page 354 of the Deed Records of said County; BEGINNING at an iron pin set at the intersection point of the South right -of -way line of the I. & G.N. Railroad and the West right -of -way line of Interstate Highway No. 35 for the Northeast corner hereof; • THENCE along said West right -of -way line S47 ° 15'E, passing a concrete right -of -way marker at 20.0 feet, a total distance of 68.20 feet to an iron pin set and S29 ° 30'E, 141.29 feet to an iron pin set for the Southeast corner hereof and the Northeast corner of the remainder of that 2.4 acre tract conveyed to the Round Rock Independent School Dis- trict found of record in Volume 281, Page 115 of said Deed Records; THENCE S42 "57'W, 108.12 feet to an iron pin set for the most Easterly corner of a•second tract of 0.077 acres that was conveyed to the Round Rock Independent School District found of record in Volume 818 , Page 351 of said Deed Records; THENCE along the North line of the second 0.077 acre tract and the South line of the first 0.077 acre tract S64 ° 09'W, 173.07 feet to an iron pin set for the Southwest corner hereof and first tract of 0.077 acres; THENCE N19'37'W, 158.09 feet along the West line of said first 0.077 acre tract to an iron pin set for the Northwest corner of said tract and the Northwest corner hereof, being in the South right -of -way line of said I. & G.N. Railroad; THENCE N42 ° 57'E, 239.01 feet along said right -of -way line to the POINT OF BEGINNING of this described tract containing 1.154 acres of land more or less. I, Timothy E.
