ANNEXATION OR CITY LIMITS EXTENSION PETITION
TO THE MAYOR AND GOVERNING BODY OF THE CITY OF ROUND ROCK,
TEXAS.
The undersigned owners of the hereinafter described
tract of land, which is vacant and without residents, or on
which less than three (3) qualified voters reside, hereby
petition your Honorable Body to extend the present city
limits so as to include as a part of the City of Round Rock,
Texas, the following described territory, to -wit:
(see Exhibit "A ")
We hereby certify, under oath, that:
(1) WE ARE THE TRUE AND ONLY OWNERS OF THE ABOVE
DESCRIBED TRACT OF LAND and as evidence thereof we have
attached as Exhibit "B" a true and current copy of the
Warranty Deed whereby we acquired said property, and
(2) the above described tract of land is contiguous and
adjacent to the current city limits of the City of Round
Rock, Texas.

of the sum of Ten and no /100 ($10.00) Dollars and other valuable
consideration to the undersigned paid by the Grantees herein
named, the receipt of which is hereby acknowledged, and the
further consideration of the execution and delivery by Grantees
of their one certain promissory note of even date herewith in the
principal sum of Three Hundred Twenty -eight Thousand and no/100
Dollars ($328,000.00), payable to the order of InterFirst Bank NW
Austin, N.A., which $328,000.00 represents funds advanced by
InterFirst Bank NW Austin, N.A., to the Grantors herein, at the
request of and as a loan to the Grantees herein in payment of the
purchase price of the property herein conveyed, which note is
payable as _therein provided; which note contains the usual
accelerated maturity, 10% attorney's fee and default clauses, and
in addition to the vendor's lien retained herein in favor of
InterFirst Bank NW Austin, N.A., securing its payment, the
Grantees herein have executed a Deed of Trust of even date with

if any, relating to the hereinabove described property, but only

prepared by Steven D. Kallman, Registered Public Surveyor No.

TO HAVE AND TO HOLD the above described premises, together
with all and singular the rights and appurtenances thereto in
anywise belonging unto-the said Grantees, their heirs and assigns
forever; and we do hereby bind ourselves, our heirs, executors
and administrators to WARRANT AND FOREVER DEFEND all and singular
the said premises unto the said Grantees, their heirs and assigns
against every person whomsoever lawfully claiming or to claim the
same or any part thereof.
But it is expressly agreed that a vendor's lien is created
herein in favor of InterFirst Bank NW Austin, N.A., and said bank
will hold superior title in and to the above described property,
premises and improvements, and the title in the Grantees will not
become absolute until the abcve described note, together with all
renewals and extensions thereof, and all interest and other
charges therein stipulated, are fully paid, according to the face
and effect and reading thereof, when this deed shall become
absolute; and it shall be the same as if a vendor's lien was
retained in favor of the Grantors herein and assigned by proper
assignment to InterFirst Bank NW Austin, N.A. without recourse on
Grantors in any manner for the payment of said indebtedness.

AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING
OF 31.81 ACRES OF LAND, WHICFI SAID TERRITORY
LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY
LIMITS OF THE CITY OF ROUND ROCK, TEXAS.
WHEREAS, in accordance with Art. 970a, V.A.T.S., two
public hearings were held before the City Council of the City
of Round Rock, Texas, where all interested persons were
provided an opportunity to be heard on the proposed annexa-
tion of the property described in Exhibit "A" attached hereto
and made a part hereof, and
WHEREAS, one of the public hearings was held within the
area proposed to be annexed, on the

19 83 , and the other public hearing was held in the Council
Chambers on the 11th day of August , 19 g3 ; which
hearing dates were not more than forty (40) days nor less
than twenty (20) days prior to institution of annexation

a newspaper having general circulation in the City of Round
Rock, Texas, on the 18th day of August , 19 83 , which
date is not more than twenty (20) days nor less than ten (10)
.days prior to each hearing, and
WHEREAS, the planning department has prepared a service
plan that provides for the extension of municipal services
into the territory to be annexed, and
WHEREAS, the territory lies adjacent to and adjoins the
present boundaries of the City of Round Rock, Texas, and
WHEREAS, all requirements of the laws of the of
Texas and the Home Rule Charter of the City of Round Rock
have been complied with, and
WHEREAS, the territory above described contains 31.81
acres; nos therefore,

Section 1. The land and territory, described in Exhibit
"A ", which is attached hereto and made a part hereof, lying
adjacent to and adjoining the present boundaries of the City
of Round Rock, Texas, is hereby added and annexed to the City
of Round Rock, Texas, and said territory hereinafter
described shall hereafter be included within the boundary
limits of the City of Round Rock, Texas, and the present
boundary limits of such city, at the various points
contiguous to the area hereinafter described, are altered and
amended so as to include said area within the corporate
limits of the City of Round Rock, Texas.
Section 2. The above described territory and the area so
annexed shall be a part of the City of Round Rock, Texas, and
the inhabitants thereof, if any, shall be entitled to all of
the rights and privileges of all the citizens and shall be
bound by the acts, ordinances, resolutions and regulations of
the City of Round Rock, Texas.
Section 3. The service plan providing for the extension
of municipal services into the territory to be annexed is
attached hereto as Exhibit "B" and such plan is hereby
adopted and approved.

WHEREAS, in accordance with Art. 970a, V.A.T.S., two
public hearings were held before the City Council of the City
of Round Rock, Texas, where all interested persons were
provided an opportunity to be heard on the proposed annexa-
tion of the property described in Exhibit "A" attached hereto
and made a part hereof, and
WHEREAS, one of the public hearings was held within the
area proposed to be annexed, on the 11 day of August
19 83 , and the other public hearing was held in the Council

AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS,
AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING
OF 31.81 ACRES OF LAND, WHICH SAID TERRITORY
LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY
LIMITS OF THE CITY OF ROUND ROCK, TEXAS.
Chambers on the 11th day of August , 19 8l ; which
hearing dates were not more than forty (40) days nor less
than twenty (20) days prior to institution of annexation
proceedings, and
WHEREAS, notice of both public hearings was published in
a newspaper having general circulation in the City of Round
Rock, Texas, on the 18th day of August , 19 83 , which
date is not more than twenty (20) days nor less than ten (10)
days prior to each hearing, and
WHEREAS, the planning department has prepared a service
plan that provides for the extension of municipal services
into the territory to be annexed, and
WHEREAS, the territory lies adjacent to and adjoins the
present boundaries of the City of Round Rock, Texas, and
WHEREAS, all requirements of the laws of the of
Texas and the Home Rule Charter of the City of Round Rock
have been complied with, and
WHEREAS, the territory above described contains
acres; now therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
Section 1. The land and territory, described in Exhibit
"A ", which is attached hereto and made a part hereof, lying
adjacent to and adjoining the present boundaries of the City
of Round Rock, Texas, is hereby added and annexed to the City
of Round Rock, Texas, and said territory hereinafter
described shall hereafter be included within the boundary
limits of the City of Round Rock, Texas, and the present
boundary limits of such city, at the various points
contiguous to the area hereinafter described, are altered and
amended so as to include said area within the corporate
limits of the City of Round Rock, Texas.
Section 2. The above described territory and the area so
annexed shall be a part of the City of Round Rock, Texas, and
the inhabitants thereof, if any, shall be entitled to all of
the rights and privileges of all the citizens and shall be
bound by the acts, ordinances, resolutions and regulations of
the City of Round Rock, Texas.
Section 3. The service plan providing for the extension
of municipal services into the territory to be annexed is
attached hereto as Exhibit "B" and such plan is hereby
adopted and approved.

EXHIBIT "A"
FIELD NOTES describing a 31.81 acre tract or parcel of land out of the Asa Tho-
mas Survey, Abstract No. 609, situated in Williamson County, Texas, being a por-
tion of the remainder of those certain tracts of land conveyed to Odas B. Moore
as follows: 1) that certain 21.0 acres conveyed by deed recorded in Volume
735, Page 293 of the Deed Records of said County; 2) that certain 16.62 acres
conveyed by deed recorded in Volume 646, Page 755 of said Deed Records, being
more particularly described by metes and bounds as follows:
BEGINNING FOR REFERENCE at an iron pin found at a fence corner post, being the
Northeast corner of Lot 1, Block E, Kensington Place Section 1, as shown on a
Plat of Record in Cabinet C, Slide 257 -258, of the Plat Records of said County;
thence along the division line between said Section 1 and said Moore tract,
S19 ° 26'30 "E, 431.76 feet to the point of intersection of the current City Limits
line, as described in City Ordinance No. 162, and the West line of said Moore
tract, being the Northwest corner and POINT OF BEGINNING of the hereinafter
described 31.81 acres;
THENCE along a line 500 feet South of and parallel to the North right -of -way
line of Gattis School Road, being the North line hereof, N81 ° 37'E, 561.35 feet
to a point in the West line of that certain 62.38 acres conveyed to Everett R.
Moore by deed recorded in Volume 816, Page 667 of said Deed Records, being a
point in the East line of said 16.62 acres, being the Northeast corner hereof;
THENCE along the fenced division line between said 62.38 acres and said 16.62
acres, being the East line hereof, the following three (3) courses:
1) S19 ° 27'40 "E, 558.32 feet to an iron pin set in said fence line, being an
angle point hereof;
2) S19 ° 24'20 "E, 946.83 feet to an iron pin found in said fence line, being an
angle point hereof;
3) S19 ° 22'50 "E, 959.66 feet to an iron pin found at a fence corner post, being
the Southwest corner of said 62.38 acres and the Southeast corner of said 16.62
acres, being the Southeast corner hereof;
THENCE along the fenced South line of said 16.62 acres, being the South line
hereof, S71 ° 14'30 "W, 550.45 feet to an iron pin set, being the Southeast corner
of Lot 18, Block R, Kensington Place Section 3, as shown on a Plat of Record in
Cabinet E , Slide 208 -210, of said Plat Records, and the Southwest corner of
said 16.62 acres, being the Southwest corner hereof;
THENCE along the fenced East line of said Section 3, and an East line of said
Section 1, being the West line of said 16.62 acres and said 21.0 acres, being
the West line hereof, the following three (3) courses:
1) N19 ° 24'50 "W, 1158.87 feet to an iron pin found, being the Southwest corner
of said 21.0 acres and the most Westerly Northwest corner of said 16.62 acres,
being an angle point hereof;
2) N19 ° 18'10 "W, 100.35 feet pass an iron pin found in the South right -of -way
of Stratford Drive, a fifty (50) foot wide right -of -way, being the Northeast
corner of Lot 1, Block R of said Section 3, and continue a distance of 50.11
feet, being a total distance of 150.46 feet to an iron pin found in the North
right -of -way line of said Stratford Drive, being the Southeast corner of Lot 9,
Block L of said Section 3, being an angle point hereof;
3) N19 ° 26'30 "W, 1256.63 feet to the POINT OF BEGINNING of the herein described
tract of land containing 31.81 acres of land more or less.

SERVICE PLAN

ACRES OF LAND, MORE OR LESS
The City of Round Rock, Texas will provide for the
extension of municipal services into the territory to be
annexed in accordance with the following schedule:
1. Police protection - immediately upon annexation.
2. Fire protection - immediately upon annexation.
3. Solid waste collection - immediately upon
annexation.
4. Maintenance of existing water and wastewater
facilities - immediately upon annexation.
5. Maintenance of existing public roads, streets
and street lighting - immediately upon annex-
ation.
6. Maintenance of existing public parks, play-
grounds, and swimming pools - immediately upon
annexation.
7. Maintenance of any existing publically owned
facility building or service within the
territory to be annexed - immediately upon
annexation.
8. Capital improvements sufficient for providing
municipal services for the subject tract are in
place such that the cost associated with the
extension of service lines to proposed building
sites within the tract will be borne by the
owner and /or developer.
