ORDINANCE NO. /09/
AN ORDINANCE AMENDING CHAPTER 11, SECTION 3, CODE OF
ORDINANCES, CITY OF ROUND ROCK, TEXAS; DEFINING CERTAIN
TERMS; AMENDING SIGN REGULATIONS; PROVIDING LIMITATIONS
ON HOME OCCUPATIONS; AMENDING REGULATIONS REGARDING
UNENCLOSED CANOPIES; ADOPTING NEW ZONING DISTRICT
DESIGNATIONS AND CLASSIFICATIONS; AMENDING REGULATIONS
REGARDING PERMITTED AND CONDITIONAL USES; AMENDING
HEIGHT AND PLACEMENT REQUIREMENTS; AMENDING SCREENING
REQUIREMENTS; AMENDING LAND DENSITY AND INTENSITY
REQUIREMENTS; AMENDING SITE PLAN REVIEW CRITERIA;
AMENDING OFF- STREET PARKING AND LOADING SPACE
REQUIREMENTS; AMENDING THE OFFICIAL ZONING MAP;
REPEALING CONFLICTING ORDINANCES AND PROVIDING FOR A
SAVINGS CLAUSE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
I.
That Chapter 11, Sec. 3.C., Code of Ordinances, City of
Round Rock, Texas is hereby amended by adding subsection (9.1)
which shall read as follows:
(9.1) Caretaker Residence: A dwelling unit which is
used exclusively by the owner, manager, or
operator of a principal permitted use and which
is located on the same lot or parcel as the
principal use.
II.
That Chapter 11, Sec. 3.C.(16), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(16) Customary Home Occupation: An accessory
occupational or vocational use conducted entirely
within a dwelling unit by the inhabitants
thereof, which is incidental to the use of the
structure for residential purposes and does not
change the residential character of the site and
which is otherwise in conformity with the
provisions of Section 3.D.(3)(b) of this Chapter.
III.
That Chapter 11, Sec. 3.D.(2), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(2) Sians and Billboards
(a) With the exception of those signs which are
attached flatwise to a building located in
District C -1 or District I -1, no sign or
billboard shall be erected, moved, altered, added
to, enlarged, painted, or modified unless it
shall conform to the provision of Chapter 4,
Section 6, Code of Ordinances, City of Round
Rock.
IV.
That Chapter 11, Sec. 3.D.(3)(b), Code of Ordinances, City
of Round Rock, Texas is hereby amended to read as follows:
(b) Home occupations accessory to residential use
shall be subject to the following limitations:
(1) The home occupation shall be conducted entirely
within a dwelling unit which is the bona fide
residence of the practitioner(s), or entirely
within only one accessory garage building (not to
include a carport).
(2) No person other than a family member who resides
in the dwelling unit participates in the home
occupation on the premises.
(3) The residential character of the lot and dwelling
shall be maintained. Neither the interior nor the
exterior of the dwelling shall be structurally
altered so as to require compliance with
non - residential construction codes to accommodate
the home occupation. No additional buildings or
structures shall be added on the property to
accommodate the home occupation. No outdoor
storage or separate entrance shall be permitted.
(4) No direct selling of merchandise shall occur on
the premises, provided however this provision
shall not be construed to prohibit up to one
"garage sale" or other similar activity every six
months.
(5) No equipment or materials associated with the
home occupation shall be displayed or stored
where visible from anywhere off the premises.
(6) The occupation shall not produce external noise,
vibration, smoke, dust, odor, heat, glare, fumes,
electrical interference or waste run -off outside
the dwelling unit or on the property surrounding
the dwelling unit.
(7) The home occupation shall be permitted one (1)
sign not exceeding two (2) square feet in surface
area attached flatwise to the house.
(8) The street address of the home occupation shall
not be advertised through signs, billboards,
television, radio, or newspapers.
V .
That Chapter 11, Sec. 3.D.(7)(d), Code of Ordinances, City
of Round Rock, Texas is hereby amended to read as follows:
(d) Open or unenclosed terraces, porches, or roof
eaves or extensions may project into the required
front yard for a distance not to exceed four feet
(4'); provided, however, no supporting structure
for such projections may be located within the
required front yard. An unenclosed canopy may
extend into the required front yard, provided
such extension shall not be closer than ten feet
(10') to a lot line.

That Chapter 11, Sec. 3.D.(9), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(9) Exceptions to Lot Requirements
The area, width, and /or depth requirements herein
shall not prohibit the erection of a
single - family dwelling in District R -6, R -12, or
R -20 for any lot or record on the effective date
of this section, provided the setback, yard area,
and off - street parking requirements set forth
herein are met.
VII.
That Chapter 11, Sec. 3.D.(10), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(10) Exemptions
The development and use of public utility
easements for public utility purposes is exempt
from regulation by this chapter.

District R -6, pending action by the city council
on original zoning.

That Chapter 11, Sec. 3.F.(2), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(2) Permits in Temporarily Zoned Areas
In an area temporarily classified as District
R -6, no permits for the construction of a
building or use of land other than for uses
allowed in said R -6 District shall be issued by
the building official.
XI.
That Chapter 11, Sec. 3.G., Code of Ordinances, City of
Round Rock, Texas is hereby amended so that the title of said
subsection shall read as follows:

XII.
That Chapter 11, Sec. 3.G.(3), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(3) Conditional Uses
The following uses are permitted subject to a
site plan approved by the Development Review
Board: places of worship, schools, private
recreational amenities, and cluster housing
provided that the density of the cluster housing
development shall not exceed six (6) dwelling
units per acre.
XIII.
That Chapter 11, Sec. 3.H., Code of Ordinances, City of
Round Rock, Texas, is hereby amended so that the title of said
subsection shall read as follows:

XIV.
That Chapter 11, Sec. 3.H.(2), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(2) Permitted Principal Uses
All permitted principal District R -6 uses, and
two (2) dwelling units per lot.

XVI.

subsection shall read as follows:
H.1. DISTRICT R -20
(1) Intent
To establish and preserve areas of medium
intensity land use primarily devoted to high
density residential development.
(2) Permitted Principal Uses
All permitted principal District R -12 uses and up
to four (4) dwelling units per lot.
(3) Conditional Uses
Subject to site plan approval, private
recreational amenities, places of worship,
schools, day -care centers, and cluster housing at
a density not exceeding twenty (20) dwelling
units per acre.
XVII.
That Chapter 11, Sec. 3.I., Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
I. DISTRICT C -1
(1) Intent
To establish and preserve areas of medium
intensity land use primarily devoted to general
commercial and other nonindustrial activities.
(2) Permitted Principal Uses
Offices, services, amusements, governmental,
institutional, commercial, places of worship, and
other nonindustrial activities which are
conducted wholly within an enclosed building or
building.

(3) Conditional Uses
Subject to site plan approval, nonindustrial
activities which entail either unenclosed
operations or storage, schools, caretaker
residences, and combinations of commercial and
residential uses within a single building.
XVIII.
That Chapter 11, Sec. 3.J., Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
J PISTRICT I -1.
(1) Intent
To establish and preserve areas of high intensity
land use primarily devoted to light industrial
development.
(2) permitted Principal Uses
Light industry with all associated operations and
storage contained within an enclosed building and
all other commercial uses.
(3) Conditional Uses
Subject to site plan approval, commercial and
light industry which entail unenclosed operations
or storage, heavy industry provided that the
external physical effects thereof are contained
within the boundaries of the respective
development site, and caretaker residences.
XIX.
That Chapter 11, Sec. 3.K., Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
K. HETGHT_AND PLACEMENT REOUIREMENTS
(1) Except as otherwise specifically provided in this
Chapter, no building shall be erected or
maintained within the required setbacks listed
below, and no building shall be erected or
maintained which exceeds the height limit
specified below.
(2) A special front setback shall be provided across
the full width of any garage which opens for
vehicular access toward the front street.
(3) A normal front setback may be provided for
dwelling units having:
(a) A side loading garage, and;
(b) A rear loading garage.
(4) A special side setback shall be provided on the
side of a building lot adjoining a side street,
or for District R -20, C -1, and I -1, on the side

special rear yard shall be provided in Districts
C -1 and I -1 for building lots which abut either
District R -6 or R -12 to the rear. In District I -1
except as otherwise provided herein, no structure
shall exceed in height the width of the street on
which it faces plus the depth of the front
setback provided. All dimensions listed below are
in feet. For all lots platted prior to February
24, 1983, D(7) and D(9) above shall govern yard
and setback requirements.
XX.
Chapter 11, Sec. 3.L., Code of Ordinances, City of Round
Rock, Texas is hereby amended to read as follows:
L SCREENING REOUIREMENT$
All land uses established after the effective
date hereof shall be required to install and
maintain an approved visual screen along every
property line which abuts lower intensity uses
except when industrial abuts commercial. All
screens must reach a minimum height of six feet
(6'). Approved types are listed below:
(1) A solid fence or wall and /or masonry
construction.
(2) A planting screen.
(3) A landscaped earth berm.
(4) Any combination of the above.
XXI.
Chapter 11, Sec. 3.M., Code of Ordinances, City of Round

Except as otherwise specifically provided in this
Chapter, no development, use, or structure shall
exceed the density and intensity limits listed
below:
XXII.
That Chapter 11, Sec. 3.N.(3)(h), Code of Ordinances,
of Round Rock, Texas, is hereby amended to read as follows:
(h) Establishes privacy through effective screening,
bufferyards, and building location from abutting
lower- intensity land uses, except between
commercial and industrial uses or districts.
XXIII.
That Chapter 11, Sec. 3.N.(3)(1), Code of Ordinances, City
of Round Rock, Texas is hereby amended to read as follows:
(1) Provides with respect to cluster housing
development, that the proposed development
contains a lot or lots aggregating at least two
(2) acres, and a property owners' association, or
similar entity, which shall have the
responsibility and enforceable right to assess
and collect fees for the maintenance, improvement
and operation of facilities, buildings, and
grounds held in common ownership.
XXIV.
(q) The site plan specifies and depicts the number of
dwelling units within any proposed cluster
housing development, which number shall not
exceed the density of the respective zoning
district:
That Chapter 11, Sec. 3.N.(3), Code of Ordinances, City of
Round Rock, Texas is hereby amended by adding subparagraph (q)
which shall read as follows:

City
(i) R-6 - The density shall not exceed the lesser of
six (6) dwelling units per acre or twice the
density of each recorded residential subdivision
lying within two hundred feet (200') of the
proposed cluster housing development.
(ii) R -12 - The density shall not exceed the lesser of
twelve (12) dwelling units per acre or twice the
density of each recorded residential subdivision
lying within two hundred feet (200') of the
proposed cluster housing development.
(iii) R -20 - The density shall not exceed the lesser of
twenty (20) dwelling units per acre or twice the
density of each recorded residential subdivision
lying within two hundred feet (200') of the
proposed cluster housing development.
(iv) The method for determining overall density is as
follows:
Determine density of all recorded residential
subdivision within two hundred feet (200') of
the proposed tract.
Establish tiers at least two hundred feet
(200') in width from each surrounding density.
Land uses across a major thoroughfare as
designated in the Thoroughfare Plan will not be
used in calculating the density of a tract.
xxv.
That Chapter II, Sec. 3.N.(3), Code of Ordinances, City of
Round Rock, Texas is hereby amended by adding subparagraph (r)
which shall read as follows:
(r) provides, for a day care center request, that the
proposed day -care center site fronts on or
adjoins a collector street or major thoroughfare
and is on a lot or lots having a minimum size of
10,000 square feet.
XXVI.
That Chapter 11, Sec. 3.0.(1), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read as follows:
(1) Off - Street Parking Requirements
When any building or structure is erected, or an
existing building is enlarged by fifty percent
(50%) or more in floor area, off- street parking
shall be provided in accordance with the
following requirement:
(a) For each structure designed for residential or
like use, a minimum of two (2) parking spaces per
dwelling unit shall be provided plus one (1)
additional parking space per room, excluding the
kitchen, one living room, one dining room, two
bedrooms, and all bathrooms. Provided however,
the minimum requirement shall not exceed four (4)
parking spaces per dwelling unit.

(b) For each of the following or like uses, one (1)
parking space for each two (2) beds:
(i) Fraternity House
(ii) Sorority House
(iii) Dormitory
(iv) Rooming House
(v) Boarding House
(c) For each of the following or like uses, one (1)
parking space for each sleeping room, plus one
(1) space for each two hundred (200) square feet
of commercial floor area contained therein,
including, but not limited to, restaurants, news
stands, and cigar stores:
(i) Hotel
(ii) Motel
(d) For each of the following or like uses, one (1)
off - street parking space shall be provided for
each two hundred (200) square feet of floor area:
(i) Business Office
(ii) Professional Office
(iii) Studio
(iv) Bank
(v) Medical Clinic
(vi) Dental Clinic
(vii) Retail Store
(viii) Personal Service Establishment
(e) For each of the following or like uses, one (1)
off - street parking space shall be provided for
each three hundred (300) square feet of floor
area:
(i) Furniture Store
(ii) Appliance Store
(iii) Hardware Store
(iv) Wholesale Establishment
(v) Machinery Sales & Service
(vi) Equipment Sales & Service
(vii) Clothing Repair
(viii) Shoe Repair
(iv) Service Shop
(f) For each of the following or like uses, one (1)
parking space shall be provided for each six
hundred (600) square feet of floor area plus
spaces to accomodate all trucks and other
vehicles used in connection therewith.
(i) Manufacturing Establishment
(ii) Industrial Establishment
(iii) Research Laboratory
(iv) Testing Laboratory
(v) Creamery
(vi) Bottling Plant
(vii) Warehouse, Storage Building and Yards
(viii) Lumber Yard
(ix) Printing Shop
(x) Plumbing Shop
(g) For each of the following or like uses, one (1)
parking space shall be provided for each four (4)
seats in the main auditorium or bench seating
spaces:

'(i) Church or other place of worship
(ii) Theater
(iii) Auditorium (except school)
(iv) Sports Arena
(v) Stadium
(vi) Gymnasium
(vii) Funeral Home or Mortuary
(h) For each of the following or like uses, one (1)
parking space shall be provided for each four (4)
beds:
(i) Hospital
(ii) Sanitarium
(iii) Convalescent Homes
(iv) Homes for the aged
(i) For each of the following or like uses, one (1)
parking space shall be provided for each one
hundred (100) square feet of floor area:
(i) Dance Hall
(ii) Assembly Hall
(iii) Exhibition Hall
(iv) Restaurant
(v) Night Club
(vi) Recreation or amusement establishment
(vii) Private Club
(viii) Lodge or Country Club
(j) For each of the following or like uses, one (1)
parking space shall be provided for each three
hundred (300) square feet of floor area:
(i) Community Center
(ii) Library
(iii) Museum
(iv) Art Gallery
If an auditorium is included as part of the
building, its floor area shall be deducted from
the total and additional parking provided on the
basis of one (1) space for each four (4) seats
that it contains.
(k) All motor vehicle salesrooms and used car lots
shall provide one (1) parking space for each
eight hundred (800) square feet of sales floor or
lot area whichever is greater.
(1) All garages shall provide one (1) parking space
for each four hundred (400) square feet of gross
floor area.
(m) All mini- warehouses /self- storage facilities shall
provide one (1) parking space for each two
thousand (2000) square feet of gross floor area.
(n) All golf courses shall provide three (3) parking
spaces for each hole.
(o) All bowling alleys shall provide five (5) parking
spaces for each alley.
(p) Elementary schools, shall provide one (1) parking
space for each four (4) seats in the auditorium
or main assembly room, or two (2) spaces for each
classroom, whichever is greater.

(q) Secondary schools or colleges, shall provide one
(1) parking space for each four (4) seats in the
main auditorium or ten (10) spaces for each
classroom, whichever is greater.
XXVII.
That Chapter 11, Sec. 3.O.(2)(a), Code of Ordinances, City
of Round Rock, Texas is hereby amended to read as follows:
(a) Any use that receives or distributes materials or
merchandise by vehicle shall provide, when
required by use district regulations, off - street
loading space in accordance with the following
requirements:
(i) District C -1: One (1) loading space for each five
thousand (5,000) square feet of floor area for
the first fifteen thousand (15,000) square feet
of floor area.
(ii) District I -1: One (1) loading space for each ten
thousand (10,000) square feet of floor area.
XXVIII.
That the Official Zoning Map adopted in Chapter 11, Sec.
3.E.(2), Code of Ordinances, City of Round Rock, and as
subsequently amended, is hereby amended by the adoption of an
amended map which shall henceforth be referred to as the Official
Zoning Map referred to in the aforesaid Section. The amended map
shall refer to this ordinance by number and shall be dated as of
the effective date of this ordinance and shall bear the signature
of the Mayor.
XXIX.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
