AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS,
AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING
OF 187.36 ACRES OF LAND, WHICH SAID TERRITORY
LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY
LIMITS OF THE CITY OF ROUND ROCK, TEXAS.
WHEREAS, in accordance with Art. 970a, V.A.T.S., two
public hearings were held before the City Council of the City
of Round Rock, Texas, where all interested persons were
provided an opportunity to be heard on the proposed annexa-
tion of the property described in Exhibit "A" attached hereto
and made a part hereof, and
WHEREAS, one of the public hearings was held, in the
Council Chambers on the 8th day of November
19 84 , and the other public hearing was held in the Council
Chambers on the 20th day of November , 19 84 ; which
hearing dates were not more than forty (40) days nor less
than twenty (20) days prior to institution of annexation
proceedings, and
WHEREAS, notices of both public hearings were published in
a newspaper having general circulation in the City of Round
Rock, Texas, on the 25th day of October and the 8th day of
November, 1984, which dates are not more than twenty (20) days
nor less than ten (10) days prior to the respective hearing, and
WHEREAS, the planning department has prepared a service
plan that provides for the extension of municipal services
into the territory to be annexed, and
WHEREAS, the territory lies adjacent to and adjoins the
present boundaries of the Ciiy of Round Rock, Texas, and
WHEREAS, all requirements of the laws of the State of
Texas and the Home Rule Charter of the City of Round Rock
have been complied with, and
WHEREAS, the territory above described contains 167.36
acres; now therefore,
TEXAS:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
Section 1.
"A ", which is attached hereto and made a part hereof, lying
adjacent to and adjoining the present boundaries of the City
of Round Rock, Texas, is hereby added and annexed to the City
of Round Rock, Texas, and
described shall hereafter be

Texas, being all of that certain 118 acres conveyed to Luther E. Smith
by deed recorded in Volume 540, Page 524 of the Deed Records of said
County and all of that certain 10.00 acres conveyed to Carter Lester
and Mary Ann Lester by deed recorded in Volume 535, Page 264 of said
Deed Records, also being a portion of that certain 207.211 acres
(Parcel A) conveyed to Dyer Creek Development by deed recorded in
Volume 955, Page 547 of said Deed Records and a portion of that certain
417.60 acres conveyed to M. Glenn Neans by deed recorded in Volume 518,
Page 531 of said Deed Records, being more particularly described by
metes and bounds as follows:
BEGINNING at an iron pin found in the fenced North right -of -way line of
Gattis School Road, being the Southeast corner of that certain tract of
land conveyed to Russell Kinningham by deed recorded in Volume 643,
Page 333 of said Deed Records, being the Southwest corner of said 118
acres, said point also being an ell corner in the existing Round Rock
city limit line, being the Southwest corner hereof;
THENCE along the fenced division line between said Kinningham tract and
said 118 acres, being said city limit line being a West line hereof,
the following four (4) courses:
1) N00 ° 12'32 "W, 1185.70 feet to an iron pin found, being an angle
point hereof;
2) N82 ° 47'28 "E, 677.66 feet to an iron pin found, being an angle point
hereof;
3) N89 ° 37'58 "E, 315.52 feet to an iron pin found, being an angle point

4) N08 ° 02'50 "E, 1696.26 feet pass the South line of said 207.211 acre
(Parcel A), being the Northeast corner of said Kinningham tract and
continue a distance of 480.61 feet, in all being a total distance
of 2176.87 feet to a point, being an angle point hereof;
THENCE continue along said city limit line, the following two (2)
courses:
1) N34 ° 54'35 "E, 473.20 feet to an angle point hereof;
2) N74 ° 57'E, 472.49 feet to an angle point hereof;
THENCE departing said city limit line, in an Easterly direction, being

The City of Round Rock, Texas will provide for the
extension of municipal services into the territory to be
annexed in accordance with the following schedule:
1. Police protection - immediately upon annexation.
2. Fire protection - immediately upon annexation.
3. Solid waste collection - immediately upon
annexation.
4. Maintenance of existing water and wastewater
facilities - immediately upon annexation.
5. Maintenance of existing public roads, streets
and street lighting - immediately upon annex-
ation.
6. Maintenance of existing public parks, play-
grounds, and swimming pools - immediately upon
annexation.
7. Maintenance of any existing publically owned
facility building or service within the
territory to be annexed - immediately upon
annexation.
8. Capital improvements sufficient for providing
municipal services for the subject tract are in
place such that the cost associated with the
extension of service lines to proposed building
sites within the tract will be borne by the
owner and /or developer.
