Federal regulations require that the Office of Revenue Sharing must
receive State certification that local government boundary changes, includ-
ing annexations and disannexations, were done in accordance with State law
before revenue sharing entitlement adjustments may be made on the basis of
such boundary changes. Governor Mark White has designated the Texas
Department of Community Affairs (TDCA) as the Texas agency responsible for
this certification process. Your city has submitted information concerning
Annexation Ordinance No. 870. On the basis of the materials submitted to
date, TDCA cannot certify that this annexation was accomplished in
accordance with State law for the following reason:
The questionnaire indicates that the area annexed by
Ordinance No. 870 is less than 500 feet wide at its narrowest
point. It does not appear that the annexation was initiated
upon the written petition of the owner(s) of the annexed area
or that a mutually agreeable boundary adjustment was made
with an adjacent city as required by the Municipal Annexation
Act for such annexations. Senate Bill 967, 69th Legislature,
Regular Session, which would have permitted this annexation
did not become effective until August 26, 1985.
Current federal revenue sharing regulations provide that annexations
will not affect the city's revenue sharing entitlement unless the Office of
Revenue Sharing determines that adjustments pursuant to such annexations
would be "equitable and would not be unnecessarily burdensome, expensive, or
otherwise impracticable." [31 C.F.R. Sec. 51.24(d) (1981).]
If there is additional information which you believe would be of
assistance in addressing the problems noted above or in determining that the
boundary change was accomplished in accordance with State law, the informa-
tion should be submitted to TDCA for consideration as soon as possible. Mr.

ORDINANCE NO. /70
AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS,
AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING
OF 17.587 ACRES OF LAND, WHICH SAID TERRITORY
LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY
LIMITS OF THE CITY OF ROUND ROCK, TEXAS.
WHEREAS, in accordance with Art. 970a, V.A.T.S., two
public hearings were held before the City Council of the City
of Round Rock, Texas, where all interested persons were
provided an opportunity to be heard on the proposed annexa-
tion of the property described in Exhibit "A" attached hereto
and made a part hereof, and
WHEREAS, one of the public hearings was held within the
area proposed to be annexed, on the 14th day of March
19 85 , and the other public hearing was held in the Council
Chambers on the 14th day of March , 19 85 ; which
hearing dates were not more than forty (40) days nor less
than twenty (20) days prior to institution of annexation
proceedings, and
WHEREAS, notice of both public hearings was published in
a newspaper having general circulation in the City of Round
Rock, Texas, on the 25th day of February , 19 85 , which
date is not more than twenty (20) days nor less than ten (10)
days prior to each hearing, and
WHEREAS, the planning department has prepared a service
plan that provides for the extension of municipal services
into the territory to be annexed, and
WHEREAS, the territory lies adjacent to and adjoins the
present boundaries of the City of Round Rock, Texas, and
WHEREAS, all requirements of the laws of the State of
Texas and the Home Rule Charter of the City of Round. Rock
have been complied with, and
WHEREAS, the territory above described contains 17.587
acres; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
Section 1. The land and territory, described in Exhibit
"A ", which is attached hereto and made a part hereof, lying
adjacent to and adjoining the present boundaries of the City
of Round Rock, Texas, is hereby added and annexed to the City
of Round Rock, Texas, and said territory hereinafter
described shall hereafter be included within the boundary
limits of the City of Round Rock, Texas, and the present
boundary limits of such city, at the various points
contiguous to the area hereinafter described, are altered and
amended so as to include said area within the corporate
limits of the City of Round Rock, Texas.
Section 2. The above described territory and the area so
annexed shall be a part of the City of Round Rock, Texas, and
the inhabitants thereof, if any, shall be entitled to all of
the rights and privileges of all the citizens and shall be
bound by the acts, ordinances, resolutions and regulations of
the City of Round Rock, Texas.
Section 3. The service plan providing for the extension
of municipal services into the territory to be annexed is
attached hereto as Exhibit "B" and such plan is hereby
adopted and approved.

17.587 ACRES OF LAND, MORE OR LESS
The City of Round Rock, Texas will provide for the
extension of municipal services into the territory to be
annexed in accordance with the following schedule:
1. Police protection - immediately upon annexation.
2. Fire protection - immediately upon annexation.
3. Solid waste collection - immediately upon
annexation.
4. Maintenance of existing water and wastewater
facilities - immediately upon annexation.
5. Maintenance of existing public roads, streets
and street lighting - immediately upon annex-
ation.
6. Maintenance of existing public parks, play-
grounds, and swimming pools - immediately upon
annexation.
7. Maintenance of any existing publically owned
facility building or service within the
territory to be annexed - immediately upon
annexation.
8. Capital improvements sufficient for providing
municipal services for the subject tract are in
place such that the cost associated with the
extension of service lines to proposed building
sites within the tract will be borne by the
owner and /or developer.
