O-85-871 - 6/13/1985ORDINANCE NO. f'7/ AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 68.17 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS. WHEREAS, in accordance with Art. 970a, V.A.T.S., two public hearings were held before the City Council of the City of Round Rock, Texas, where all interested persons were provided an opportunity to be heard on the proposed annexa- tion of the property described in Exhibit "A" attached hereto and made a part hereof, and WHEREAS, one of the public hearings was held within the area proposed to be annexed, on the 9th day of May 19 85 , and the other public hearing was held in the Council Chambers on the 9th day of May , 19 85 ; which hearing dates were not more than forty (40) days nor less than twenty (20) days prior to institution of annexation proceedings, and WHEREAS, notice of both public hearings was published in a newspaper having general circulation in the City of Round Rock, Texas, on the 29th day of April , 19 85 , which date is not more than twenty (20) days nor less than ten (10) days prior to each hearing, and WHEREAS, the planning department has prepared a service plan that provides for the extension of municipal services into the territory to be annexed,, and WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Round Rock, Texas, and WHEREAS, all requirements of the laws of the State of Texas and the Home Rule Charter of the City of Round Rock have been complied with, and WHEREAS, the territory above described contains 68.17 acres; now therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: Section 1. The land and territory, described in Exhibit "A ", which is attached hereto and made a part hereof, lying adjacent to and adjoining the present boundaries of the City of Round Rock, Texas, is hereby added and annexed to the City of Round Rock, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Round Rock, Texas, and the present boundary limits of such city, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Round Rock, Texas. Section 2. The above described territory and the area so annexed shall be a part of the City of Round Rock, Texas, and the inhabitants thereof, if any, shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Round Rock, Texas. Section 3. The service plan providing for the extension of municipal services into the territory to be annexed is attached hereto as Exhibit "B" and such plan is hereby adopted and approved. Police protection - immediately upon annexation. 2. Fire protection - immediately upon annexation. 3. Solid waste collection - immediately upon annexation. 4. Maintenance of existing water and wastewater facilities - immediately upon annexation. 5. Maintenance of existing public roads, streets and street lighting - immediately upon annex- ation. 6. Maintenance of existing public parks, play- grounds, and swimming pools - immediately upon annexation. 7. Maintenance of any existing publically owned facility building or service within the territory to be annexed immediately upon annexation. 8. Capital improvements sufficient for providing municipal services for the subject tract are in place such that the cost associated with the extension of service lines to proposed building sites within the tract will be borne by the owner and /or developer. FIELD NOTES BEING a tract of land out of the N.B. Anderson Survey, Abstract No. 29, Williamson County, Texas, being a portion of that certain 101.37 acre tract of land conveyed to Logan E. Bartz and wife Bonnie R. Bartz by deed recorded in Volume 440, Page 397, Williamson County Deed Records and also being a portion of that certain 19.44 acre tract of land conveyed to Logan E. Bartz and wife Bonnie R. Bartz by deed recorded in Volume 448, Page 532, Williamson County Deed Records and being more particularly described by metes and bounds as follows: BEGINNING at an iron rod set for the southwest corner of this tract, being on the east right -of -way line of Sunrise Road (County Road No. 115) and being also the northwest corner of that tract of land conveyed to the Veteran's Land Board of Texas by deed recorded in Volume 528, Page 722, Williamson County Deed Records; THENCE with the said east line of Sunrise Road: 1. N18 °23'07 "W, a distance of 1324.38 feet to an iron rod set; 2. N18 °34'24 "W, a distance of 1015.26 feet to an iron rod set; 3. N28 °41'36 "E, a distance of 28.72 feet to an iron rod set at the intersection of the east line of Sunrise Road and the south right -of -way line of Chandler Road (County Road No. 114) for the northernmost northwest corner of this tract; THENCE with the said south line of Chandler Road N72 °24'13 "E, a distance of 1298.55 feet to an iron rod set for the northeast corner of this tract; THENCE leaving the said south line of Chandler Road: 1. S07 °19'41 "E, a distance of 1200.73 feet to an iron rod set; 2. S15 °46'49 "E, a distance of 703.86 feet to an iron rod set on the north line of the said 19.44 acre tract; THENCE crossing the said 19.44 acre tract N79 ° 51'36 "E, a distance of 847.88 feet to an iron rod set on the east line of the said 19.44 acre tract; THENCE with the east line of the said 19.44 acre tract, S02 °33'16 "E, a distance of 334.46 feet to an iron rod set for the southeast corner of this tract, being the northeast corner of the said Veteran's Land Board tract; THENCE with the north line of the said Veteran's Land Board tract, S71 °05'40 "W, a distance of 1801.81 feet to the POINT OF BEGINNING, containing 68.17 acres (2,969,349 square feet) of land, more or less.
