AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF
THE CITY OF ROUND ROCK, ADOPTED IN CHAPTER 11,
SECTION 3.(2), CODE OF ORDINANCES, CITY OF ROUND
ROCK, TEXAS AND MAKING THIS AMENDMENT A PART OF THE
SAID OFFICIAL ZONING MAP, TO -WIT: TO CHANGE 3.867
acres out of the Asa Thomas Survey, situated in
WILLIAMSON COUNTY, TEXAS, AS DESCRIBED
BELOW FROM District R -12 (Medium Density Residential) to
District C -1 (Commercial).
WHEREAS, an application has been made to the City
Council of the City of Round Rock, Texas to amend the
Official Zoning Map to change the zoning classification of
the property described in Exhibit "A" from District R -12 (Medium
Density Residential) to District C -1 (Commercial).
WHEREAS, the City Council has submitted the requested
change in the Official Zoning Map to the Planning and Zoning
Commission for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a
public hearing concerning the requested change on the 20th
day of February 1986, following lawful publication of the
notice of said public hearing, and
WHEREAS, after considering the public testimony received
at such hearing, the Planning and Zoning Commission has
recommended that the requested zoning change be denied, and
WHEREAS, on the 27th day of February 1986, after proper
notification, the City Council held a public hearing on the
requested change, and
WHEREAS, the City Council has determined that
substantial changes in conditions have occurred which justify
the zoning classification change provided for herein, and
WHEREAS, the City Council determines that the zoning
classification change provided for herein promotes the
health, safety, morals and protects and preserves the general
welfare of the community, and
WHEREAS, this ordinance has received the favorable vote
of three - fourths of all members of the Council as required by
Chapter 11, Sec. 3.U.(3)(c), and

WHEREAS, each and every requirement set forth in Art.
1011a -f V.A.T.S. and Chapter 11, Section 3, Code of
Ordinances, City of Round Rock, Texas concerning' public
notices, hearings, and other procedural matters has been
fully complied with, NOW THEREFORE
BE IT ORDAINED BY THE COUNCIL OF TFIE CITY OF ROUND ROCK,
TEXAS

That the Official Zoning Map adopted in Chapter 11,
Section 3.E.(2), Code of Ordinances, City of Round Rock,
Texas is hereby amended so that the zoning classification of
the property described in Exhibit "A" attached hereto and
incorporated herein is hereby changed from

CORRECTED FIELD NOTES FOR 3.867 ACRES
FIELD NOTES describing a 3.867 acre tract or parcel of land out of the Asa
Thomas Survey, Abstract No. 609, situated in Williamson County, Texas,
being a 3.743 acre portion of that certain 37.213 acres conveyed to Harry
L. Silverman, Jr. and E.L. Kendrick by deed recorded in Volume 920, Page
305 of the Deed Records of said County, and a 0.124 acre portion of the
remainder of that certain 1.297 acres conveyed to said Silverman and said
Kendrick by deed recorded in Volume 937, Page 491 of said Deed Records,
being more particularly described by metes and bounds as follows:
BEGINNING FOR REFERENCE at the Southeast corner of the Wiley Harris
Survey, Abstract No. 298, being an angle point in the North line of said
Asa Thomas Survey; thence S31 ° 30'E, 61.2 feet to-an -iron pin found at a
fence corner post, being the Northeast corner of Lot 1, Block E,
Kensington Place, Section 1, as shown on a Plat of Record in Cabinet C,
Slide 257 -258 of the Plat Records of said County and the Northwest corner
of said 37.213 acres, being the Northwest corner and POINT OF'BEGINNING of
the hereinafter described 3.867 acres;
THENCE along the South right -of -way line of Gattis School Road, being the
North line of said 37.213 acres, being the North line hereof, the
following three (3) courses:
1) N82 °30'E, 501.05 feet to an iron pin found, being an angle point
hereof;
2) N82 °47'E, 61.98 feet to an iron pin found, being the Northeast corner
of said 37.213 acres and the Northwest corner of said 1.297 acres,
being an angle point hereof;
3) N86 °23'20 "E, 32.03 feet to an iron pin found, being a Point of
Curvature and the Northeast corner hereof;
THENCE along the East line hereof, the following two (2) courses:
1) along the arc of a curve to the right having elements of Delta =

Analysis
Subject property is situated on the southwest corner of Gattis School Road
and Greenlawn Parkway. It is presently zoned District R -12 (Medium density
residential). It abuts single - family on the west, public park on the south,
Greenlawn Blvd. on the east and C -1 zoned (presently vacant) on the north
across Gattis School Road.
There are seven commercially zoned parcels presently located along Gattis
School Road between South Mays and Double Creek Drive containing an approx-
imate total of 48.5 acres. Immediately adjacent (on the north side of
Gattis School Road at Greenlawn Parkway) are two parcels with a total of
7.987 acres zoned C -1 commercial. Both are undeveloped at present. (See
attached map (exhibit 1).
The subject site is designated as low intensity in the general plan policy
of City of Round Rock. Thus any commercial development along Gattis School
Road should be designed to serve local commercial needs only. The parcels
already zoned commercial along Gattis School Road are more than sufficient
to meet these needs. In fact the commercial zoning immediately across Gattis
School Road alone exceeds local commercial requirements in the vicinity.
The staff therefore recommends disapproval of the request because there is
presently sufficient commercially zoned land in the area available for
development.

ITEM: 14D. Consider an ordinance amending the Zoning Ordinance
by rezoning a 3.867 acre parcel of land located on
the southwest corner of Gattis School Road and Green -
lawn Parkway from District R -12 (Medium Density Residential)
to District C -1 (Commercial). (First Reading)
This tract contains 3.867 acres and is located on the southwest corner of
Gattis School Road and Greenlawn Boulevard. It is bounded by single family
homes (District R -6) on the west, a park /detention area to the south, Greenlawn
Boulevard on the east and Gattis School Road on the north.
A prior action of the City Council approved multi - family zoning at a density
of 16 dwelling units per acre. The Development Review Board approved a site
plan but the developer /owner has let the permit expire.
At the time of this action, staff had recommended approval of commercial
zoning, however, since then, several other commercial tracts have been
approved. The result is a substantial over supply of commercially zoned
land along Gattis School Road as required to serve a localized population in the
area.
Staff recommends disapproval of this request because of the abundance of
commercially zoned land in the area.
Planning and Zoning Commission Action: The Planning and Zoning Commission
voted to disapprove this request at their - ''meeting on February 20, 1986. The
vote is as follows:
Ayes: 3 Commissioners
Nays: 2 Commissioners
Absent: 2 Commissioners
Abstain: 0
Action: The vote was 3 to 2 to disapprove.
