I.
AN ORDINANCE AMENDING CHAPTER 8, SECTION 6.J. (4) (b) (c) (e);
SECTION 6.K. (10) (a) (b) (c) and (e), TO MODIFY THE MINIMUM
SIZE WATER AND WASTEWATER MAIN ELIGIBLE FOR REIMBURSEMENT:
PROVIDING A SAVINGS CLAUSE, AND REPEALING CONFLICTING ORDI-
NANCES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
That Chapter 8, Section 6.J. (4) (b), Code of Ordinances,
City of Round Rock, Texas is hereby amended to read as follows:
(b) Oversize - On -Site Mains: Where it is determined that
an on -site main needs to be of a larger size than that
required to serve the tract to be developed, the City
may require the developer to install such oversized
main. For mains up to sixteen inches (16 ") the
developer shall be reimbursed the incremental cost
difference required for oversizing from the oversize
account described in paragraph (d) below. For over-
sized mains in excess of sixteen inches (16 "), the
developer will be reimbursed for the incremental cost
difference required for oversizing from the oversize
account approved for Capital Improvement Projects,
or through reimbursement contracts. All reimburse-
ment contracts shall contain a provision terminating
the City's obligation to reimburse costs after five
(5) years from the effective date of the contract.
II.
That Chapter 8, Section 6.J. (4) (c), Code of Ordinances,
City of Round Rock, Texas is hereby amended to read as follows:
(c) Oversize - Approach Mains: Where it is determined that
an approach main needs to be of a larger size than
that required to serve the tract being developed, the
City may require the developer to install such over-
sized main. Subject to review by the Planning and
Zoning Commission and approval by the City Council,
the City may reimburse the developer for the incre-
mental cost difference required for the oversizing
of approach mains. Upon Council approval, the reim-
bursement for approach mains will be paid out of the
oversize account described in paragraph (d) below,
from funds approved for Capital Improvement Projects,
through reimbursement contracts or any combination
thereof. The manner of reimbursement shall be solely
at the Council's descretion. All reimbursement con-
tracts shall contain a provision terminating the City's
obligation to reimburse costs after five (5) years
from the effective date of the contract.
That Chapter 8, Section 6.J. (4) (e), Code of Ordinances,
City of Round Rock, Texas is hereby amended by inserting the
following as the first sentence of paragraph (e):
To be reimbursed, a developer shall present in writing
to the Public Works Director, a statement of oversize
credit proposed. This statement shall be presented no
later than the end of the normal working day, eight
days prior to the regular City Council meeting, at which
time acceptance of the respective oversize line is
considered.
IV.
That Chapter 8, Section 6.K. (10) (a), Code of Ordinances,
City of Round Rock, Texas, is hereby amended by subtituting
the word "Wastewater" for the word "Water" in the third sen-
tence.
V.
That Chapter 8, Section 6.K. (10) (b), Code of Ordinances,
City of Round Rock, Texas, is hereby amended to read as follows:

VIII.
A. The invalidity of any section or provision of this
Ordinance shall not invalidate other sections or provisions
thereof.
B. All Ordinances, parts of Ordinances, or Resolutions
in conflict herewith are expressly repealed.

this Ordinance on two separate days was dispensed with.

ITEM: 11E - Consider an ordinance modifying the Oversize
Ordinance in relation to minimum size. (First
Reading)
This item was on the work session last Council meeting.
The focus of this modification is to increase the minimum size
of an onsite line from 12" to 16" to reflect current line sizing.
Also, this permits the oversize account to be used for off -site
oversizing of larger diameters.
