AND CHAPTER 11, SECTIONS 3.N. AND 3.U., CODE OF ORDINANCES,
CITY OF ROUND ROCK, TEXAS, BY AMENDING REQUIREMENTS FOR
SUBDIVISION PROCESSING PROCEDURE FOR CONCEPT PLANS, WAIVER
OF CONCEPT PLANS, FINAL PLATS, PLAT VACATION INSTRUMENTS
AND RECORDATION OF FINAL PLATS; BY AMENDING REQUIRED
INFORMATION ON SITE PLANS AND RE- ZONING APPLICATIONS;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
ORDINANCES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
I.
That Chapter 8, Section 5.A., Code of Ordinances, City of Round
Rock, is hereby amended by adding a paragraph (9) which shall read as
follows:
(9) Abstractor's Certificate
That Chapter 8, Section 5.C.(1), Code of Ordinances, City of
Round Rock, is hereby amended by adding a sub - paragraph (a)(iii)
which shall read as follows:
(a) ...
III.
That Chapter 8, Section 5.C., Code of Ordinances, City of Round
Rock, is hereby amended by adding a paragraph (2) which shall read as
follows:
(2) Abstractor's Certificate
The final plat shall be accompanied by an abstractor's
certificate which shall state the names and addresses of
any and all current owners and current lienholders of the
property described in the final plat. The abstractor's
certificate shall be dated no sooner than ten (10) days
prior to the submission of the final plat. The final plat
shall not be reviewed or approved until the receipt of the
abstractor's certificate.

The concept plan shall be accompanied by an abstractor's
certificate, which shall state the names and addresses of
any and all current owners and current lienholders of the
property described in the concept plan. The abstractor's
certificate shall be dated no sooner than ten (10) days
prior to submission of the concept plan. The concept plan
shall not be reviewed or approved until the receipt of the
abstractor's certificate.
II.
(iii) when the requirement for a concept plan is waived in
accordance with (i) and (ii) above, the applicant
shall provide an abstractor's certificate which shall
state the names and addresses of all current owners
and current lienholders of the property. The
abstractor's certificate shall be dated no sooner
than ten (10) days prior to the waiver of the concept
plan. The concept plan will not be waived until the
receipt of the abstractor's certificate.
IV.
That Chapter 8, Section 5.C., Code of Ordinances, City of Round
Rock, is hereby amended by adding a paragraph (3) which shall read as
follows:
(3) Abstractor's Certificate for Plat Vacations
Any plat vacation document submitted for approval by the
Planning and Zoning Commission shall be accompanied by an
abstractor's certificate which shall state the names and
addresses of any and all current owners and current lien
holders of the property described in the plat vacation
document. The abstractor's certificate shall be dated no
sooner than ten (10) days prior to the submission of the
plat vacation document. The plat vacation document shall
not be reviewed or approved until the receipt of the
abstractor's certificate.
V.
That Chapter 8, Section 5.C., Code of Ordinances, City of Round
Rock, is hereby amended by adding a paragraph (4) which shall read as
follows:
(4) Abstractor's Certificate for Recordation of Plats after
Approval by Planning and Zoning Commission
If a final plat is to be recorded thirty (30) or more days
after approval of final plat by the Planning and Zoning
Commission, an abstractor's certificate shall be submitted
to the Director of Planning. Said abstractor's certificate
shall state the names and addresses of all current owners
and current lienholders of the property. The certificate
shall be dated no sooner than ten (10) days prior to the
recordation of the final plat.'
VI. -
That Chapter 11, Section 3.N., Code of Ordinances, City Of Round
Rock is hereby amended by adding a paragraph (9) which shall read as
follows: a ,
(9) Abstractor's Certificate
Every site plan shall be accompanied by an abstractor's
certificate, which shall state the names and addresses of
any and all current owners and current lienholders of the
property described in the site plan. The abstractor's
certificate shall be dated no sooner than ten (10) days
prior to the submission of the site plan. The site plan
shall not be reviewed or approved until the receipt of the
abstractor's certificate.
VII.
That Chapter 11, Section 3.U.(1), Code of Ordinances, City of
Round Rock is hereby amended by adding a sub- paragraph (d) which
shall read as follows:
(d) Each application shall be accompanied by an abstractor's
certificate, which shall state the names and addresses of
all current owners and current lienholders of the property
described in the application. The abstractor's certificate
shall be dated no sooner than ten (10) days prior to
submission of the application. The application shall not be
reviewed or approved until the receipt of the abstractor's
certificate.

A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions thereof.

Subdivision Ordinances to require an Abstractor's
Certificate for Plat, Zoning, PUD, Vacation and
Site Plan applications prior to recording Final
Plats.

STAFF RECOMMENDATION: Approval.
The proposed amendments to the Subdivision and the Zoning
Ordinances will require the applications listed below to be
accompanied by an Abstractors Certificate which shall state the
names and addresses of any and all current owners and current
lienholders of the subject property. This certificate shall be
dated no sooner than 10 days prior to submission of the application
or request to record. The applications and actions which will
require this certificate are as follows:
1. Concept Plans
2. Final Plats
3. Site Plans
4. Plat Vacation Documents
5. Request to Record Final Plats
6. Rezoning Application
7. PUD Applications
The need to verify the ownership of property which is the subject
of a Subdivision or Zoning application has become a major concern,
due to often rapidly changing ownership in the present economy.
The requirement for an Abstractors Certificate provides the most
current ownership information. It also provides the necessary
list of lienholders who hold an interest in the property. This
assures the City that the applicant, in fact, has the authority
to make the application.
ECONOMIC IMPACT: No cost to the City.
