_AN ORDINANCE PROVIDING FOR A PROCEDURE TO AMEND THE ROUND
ROCK GENERAL PLAN; PROVIDING FOR A SAVINGS CLAUSE; AND
ESTABLISHING AN EFFECTIVE DATE. ,
WHEREAS, the City Council of Round Rock, Texas has adopted a
General Plan for the City and.its: extraterritorial jurisdiction, and
WHEREAS, it is the intent of the Round Rock City Council that the
Round Rock General Plan undergo periodic review for the purpose of
possible revision, and
WHEREAS, Texas law provides that a city's comprehensive plan may
be amended by a city council at any time, Now Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
I.
That Chapter 11, Section 2, Code of Ordinances, City of Round
Rock, Texas, is hereby amended by adding a Subsection D, entitled
CHANGES AND AMENDMENTS TO GENERAL PLAN, which said Subsection shall
read as follows:
D. CHANGES AND AMENDMENTS TO THE GENERAL PLAN
(1) City Council May Amend General Plan
The City Council may, from time to time, amend,
supplement, change, modify or repeal the General Plan
or portion thereof.
(2) Procedure Before the Planning and Zoning Commission
(a) The Planning and Zoning Commission shall hold a
public hearing to consider all proposed
amendments to the General Plan. Notice of the
public hearing shall be given by publishing same
in a newspaper, of general circulation in the
City of Round Rock, at least ten (10) days prior
to the date set for the hearing, and shall state
the time and place of the hearing.

(b) Upon such hearing, all interested parties shall
have the opportunity to give testimony or make
inquiries regarding any proposed amendment.
(c) After such hearing, the Planning and Zoning
Commission shall make its recommendation
regarding any proposed amendment.
(d) Each such recommendation made by the Planning and
Zoning Commission, shall be reported to the City
Council in writing.
(3) Procedure Before the City Council
(a) After receiving the recommendation of the
Planning and Zoning Commission, the City Council
shall hold a public hearing on same. Notice of
the public hearing shall be given by publishing
same in a newspaper, of general circulation in
the City of Round Rock, at least fifteen (15)
days prior to the date set for the hearing, and
shall state the time and place of the hearing.
(b) The City Council shall be at liberty to accept,
reject, or take other action on the recommen-
dation it receives from the Planning and Zoning
Commission, provided that such action furthers
the health, safety, and general welfare of the
residents of the City.
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this ordinance
shall not invalidate other sections or provisions thereof.

By motion duly made, seconded and passed with an affirmative vote
of all the Council members present, the requirement for reading this

STAFF RECOMMENDATION: APPROVAL
THIS ORDINANCE WILL ESTABLISH A PROCEDURE FOR THE PERIODIC AMENDMENT OF THE
ROUND ROCK GENERAL PLAN. THESE PROCEDURES HAVE BEEN DRAFTED TO BE GENERALLY
THE SAME AS THOSE REQUIRED FOR AMENDING THE ZONING ORDINANCE.
THEY INCLUDE THE FOLLOWING:
(1) ADVERTISEMENT IN THE NEWSPAPER 10 DAYS PRIOR TO CONSIDERATION BY THE
PLANNING AND ZONING COMMISSION AND 15 DAYS PRIOR TO CONSIDERATION BY
CITY COUNCIL.
(2) A PUBLIC HEARING BEFORE THE PLANNING AM) ZONING COMMISSION.
(3) A RECOMMENDATION FROM THE PLANNING AND ZONING COMMISSION.
(4) A PUBLIC HEARING BEFORE THE CITY COUNCIL.
(5) ACTION BY THE CITY COUNCIL
