AND 11.A., CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS BY ADDING AN EXPIRATION DATE FOR FINAL UNRECORDED PLATS, AND PROVIDING REVISED FEES FOR CERTAIN FINAL PLATS, PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 8, Section 5.C., Code of Ordinances, City of Round Rock, Texas, is hereby amended by adding a paragraph (2) which shall read as follows: (2) Expiration of Plat Approval An unrecorded final plat expires six (6) months from the date the Planning and Zoning Commission officially approved the plat. The Planning and Zoning Commission may, if a written application and fee is received from the owner prior to the expiration of the plat, grant one (1) extension of up to six (6) additional months. If any major changes are required by the Planning and Zoning Commission, the Commission may require the submission of a revised final plat. An approved but unrecorded plat, existing at the time of passage of this ordinance, shall expire six (6) months from the date on which this ordinance was finally approved and adopted. III. That Chapter 8, Section 11.A., of the Code of Ordinances, City of Round Rock, Texas, is hereby amended by adding a paragraph (5) which shall read as follows: (5) Applications for the extension of a final plat approval, one hundred dollars ($100.00). Iv. A. All ordinances, parts of ordinances or resolutions in conflicts herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Consider an ordinance amending the Subdivision Ordinance by providing for an expiration of final plat approvals when the plat is not recorded. (Second Reading) STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: APPROVAL This ordinance will provide for the expiration of final plat approvals when a final plat is not recorded within 6 months of its approval by the Planning and Zoning Commission. The ordinance will also provide for a six month extension of this approval by the Planning and Zoning Commission. Extensions would require a one hundred dollar application fee. All plats which have been previously approved but not recorded will have their approvals extended for six months from the date of adoption of this ordinance.
